Roll Call The roll was taken by Contract Secretary Roper and confirmed as follows: Commissioners present: R. Fullinck, S. Romain, R. We11s, P. Bryson, T. Lewis Commissioners absent: J. Twait Others present: Council Member R. Molloy, Department Assistant N. Carver, Contract Secretary B. Roper A quorum was present. 1-b. PZ07-L0 -- An application for a Conditional Use Permit for a daycare facility for the property known as Lot 7, Block 2, Bush Lanes Subdivision (1228 Lilac Lane), Kenai, Alaska. Application submitted by Tammy Christin dba Building Blocks-n- Buddies, 122$ Lilac Lane, Kenai, Alaska. Department Assistant Carver reviewed the staff report, noting: • The application for a Conditional Use Permit was made to expand a daycare business. • At its February 14, 2007 meeting, the Planning 8v Zoning Commission approved a Home Occupation Permit to allow the applicant to care for eight (8J children. • If approved, the Conditional Use permit would allow the applicant to care far twelve (12) children. • The applicant has obtained necessary approval and licensing from the State to care for twelve children. Staff recommends approval with the following recommendations: All vehicles must be parked on said property. • Play area must be fenced na later than August 3I, 2007. • Applicant must stay in compliance with all Federal, State and local regulations. Vice-Chairman Wells opened the public hearing. There being no public comment; the public hearing was closed. MOTION: Commissioner Romain MOVED to approve PZ07-10 including staff recommendations. Discussion -- KMC 12.20.030 Debris and junk prohibited. Discussion included the following: • Reference was made to an a-mail (included in the packet) discussing the debris and junk ordinance. PLANNING & ZONING COMMISSION MEETING FEBRUARY 28, 2007 PAGE 2 + The issue was before City Council and no action was taken. + The issue was requested to be brought to the Commission for review and to determine whether a recommendation should be made to Council to revisit the ordinance. required. This vacation was approved; however, a 15-foot utility easement was retained. That plat was not recorded. This plat begins the process again. The current plat dedicates a 30-foot right-of--way along Highbush Lane and dedicates a 15-foot utility easement along the southern portion of Lot 1. Sunscape Way #144 509-961-0972 Casa Grande, AZ 85222 Requested Action: Rezone -Conservation {C) to Suburban Residential (RS) Legal Description: Lot 1A, Block 6 Redoubt Terrace Bluff View Replat (Preliminary Plat approved January 24, 2007) Street Address: 406 South Forest and None KPB Parcel No.: 04714024 & portion of 04701026 Existing Zoning: Suburban ResidentiallConservation Current Land Use: ResidentialNacant Land Use Plan: Neighborhood ResidentiallConservation Open Space ANALYSIS General Information: The applicant processed a preliminary plat that combined two parcels into one parcel. One parcel was zoned Conservation {C} and the other zoned Suburban Residential (RS}. This application will eliminate a possible split-zone situation as result of the plat. The requirement to apply for the rezone was a recommendation by the City of Kenai's Planning & Zoning Commission when the preliminary plat was reviewed on January 24, 2007. KMC 14.20.270 describes amendment procedures. Section 2 states, "Amendments to the Official Zoning Map shall be considered only if the area to be rezoned contains a minimum of one (1) acre (excluding street or alley rights-of-way) unless the amendment enlarges an adjacent district boundary," The area of this rezone enlarges an adjacent boundary. City Engineer: The rezone is the southerly portion of Lot 1A.
