There were no objections. SO ORDERED. ITEM 2: APPROVAL OF MINUTES -- January 10, 2007 Approved by consent agenda. ITEM 3: SCHEDULED PUBLIC COMMENT -- None ITEM 4: CONSIDERATION OF PLATS 4-a. P207-04 -- Prelixinary Plat for Sprucewood Glen Subdivision No 9 (A resubdivision of Sprucewood Glen Subdivision Lots A3 8a A4, KRD 84- 305 & Lot A2-B, KRD 86-114). City Planner Kebschull noted the following: • The plat would subdivide three parcels to create five parcels of various sizes. • The properties are zoned General Commercial and the resulting lots would meet the zone requirements. • There are cross-access agreements between parcels to provide ingress and egress to the Kenai Spur Highway. • There is a recorded right-af-way agreement for access off Walker Lane. • Lot A-1 has a building code violation but it is not a part of this plat. • Staff recommended approval. Commissioner Twait read the rules of a public hearing and opened the meeting for public comments. There were no public or Commission comments. MOTION: Commissioner Bryson MOVED to adopt PZ07-04 and Commissioner F~.illinck seconded the motion. VOTE: There were no objections. SO ORDERED. 4-b. PZ07-05 -- Preliminary Plat for Williams Subdivision 8s ROW Easement Vacation (A resubdivision of Government Lot 941ocated within the SE E/4 Section 34, T6N, R11W, S.M.). Plat submitted by Integrity Surveys, 8195 Kenai Spur Highway, Kenai, Alaska. City Planner Kebschull noted the following: • A vacation of the 33-foot ROW easement was approved for the south 33- foot of Governxnen.t Lot 94 in October 2005, however, a 15-foot utility easexent was retained. • When this plat was received, administration believed it was formalizing the 2005 vacation. • The surveyor had advised they are starting the process over because of the delay and that they no longer want to dedicate the 15-foot utility easement. • Kebschull advised the applicant that if this plat was to start the vacation process over, the City would not formally receive the vacation until the Borough has approved it; at that time, Council would have 30 days to veto or approve the vacation; and, Administration would be recomxnending to Council the vacation be vetoed if it did not include the utility easement. PLANNING & ZONING COMMISSION MEETING JANUARY 24, 2007 PAGE 2 • In 1996 asingle-family dwelling was built on the lot and the City has verification that there are no encroachments. • The City Engineer noted the I5-foot utility easement would match the one retained along the southerly adjoining lot. • The easement also coincides with the 15-foot setback for that zone. • Staff recommended approval with the requirement the plat be corrected to Shaw the 15-foot utility easement along the south property line. ChairmanTwait opened the meeting for public comment. Cliff Baker, Integrity Surveys, Kenai, Alaska -- Mr. Baker reported he was representing the property owner, John Williams who was out of town and unable to attend the meeting. Baker requested the item be postponed to the next meeting. The public comment portion of the meeting was closed. MOTION: Coxnmissioner Bryson MOVED to postpone PZ07-05 until the next regular Planning and Zoning meeting and Commissioner Wells SECONDED the motion. There were no objections. SO ORDERED. 4-c. PZ07-06 -- Preliminary Plat for Redoubt Terrace, Bluff View Replat (A replat of Lot 1, Block 6, Redoubt Terrace Subdivision, Additional No. 3 and subdivision of a portion of Government Lot 5 located within the SE 1/4 NWS 1/4 Section 6, T5N, R11W, S.M.). Plat submitted by Integrity Surveys, 8195 Kenai Spur Highway, Kenai, Alaska. City Planner Kebschull noted the following: • Approval of the plat would subdivide 12,226 sq. ft. from Government Lot 5 and combine it with the current Lot 1. • The new parcel would create a split zone situation with the new portion being zoned Conservation and the original tat being zoned Suburban Residential. • The parcel would be served by city water and sewer, would accessed off South Forest Drive and Toyon Way, and an installation agreement would not be required. • The structure located on the current Lot 1 was granted an encroachment permit on appeal for 9.9 feet into the side yard setback. This plat would eliminate the encroachment. • According to City and Borough records, Lot 1, Block 6 was developed with a six~unit condominium with multiple owners. • Ownership of the parcel should be verified. • Staff recommended approval with the recommendation the applicant request and receive a rezone of the Conservation portion of the lot to Suburban Residential and correct the street name to South Forest Drive. PLANNING 8v ZONING COMMISSION MEETING JANUARY 24, 2007 PAGE 3 Commissioner Twait opened the meeting to public comment. Cliff Baker, Integrity Surveys, Kenai, Alaska -- Mr. Baker noted the following: • He was representing the property owner and noted the plat had been. approved by the Borough as an either/or situation (as a separate parcel or as an addition to the Craig parcel.) • He was not sure how the City was looking at it. • The retaining wall owned by the City at end of Forest Drive was encroaching an the property, however there appeared to be an easement but he did not have an opportunity to research it. • He was bringing the encroachment to the Commissions' attention because verification there were na encroachments was a condition of the plat being approved. Commission discussion followed and comments included: • Commissioner Bryson asked if the 35 feet on the south end was on the subdivided area and Baker replied it was like a flagged portion. Commissioner Bryson suggested it be so designated and Baker indicated he may do that. • Baker, referring to staff's recommendation of a rezone, stated that if the rezone was done before the plat was recorded, then there would be a split-zone on the other piece of property without a complete, legal description to fit it and it seemed the rezone should be dare after it is recorded so one would know what to take out of the other parcel. • City Planner Kebschull stated that had been a problem but staff had found in the past that with subdivisions they do not fulfill all the requirements prior to the recording and oftentimes they do not come back. • Kebschull added, the large unsubdivided remainder was already a spiit- zone situation with Suburban Residential on the west side and Conservation along the bluff and was currently not an issue. • Baker asked if it was staff s recommendation that they go ahead and split zone before it is recorded and Kebschull stated staff was recommending it be rezoned so it would not be a split-zoned parcel. Public comment was closed. MOTION: Commissioner Romain MOVED to approve PZ07-06 and Commissioner Fullinck SECONDED the motion. Discussion continued with comments including: • Bryson stated, by interpretation it meant the zone edges would run along the property line. • Kebschull replied, they did not in the past; there were large areas zoned according to the use of the property which the city has been working to clean up; staff was recommending a rezone but if the Commission felt it was not reasonable, then PLANNING Sv ZONING COMMISSION MEETING JANUARY 24, 2007 PAGE 4 they could recommend it not be rezoned. However, if there was interest to build on the parcel in the future, a rezone would be required. Kebschull was asked what benefit would there be to rezone and she indicated that could not be addressed. • Baker reported this had been in dispute far quite some time and indicated his client believed he owned out to where the bluff breaks over. As a result, his client developed his property based on that and he was actually encroaching in the rear property setback on the existing parcel. Baker added his client had Landscaped the area and had been using it as part of his property although it belonged to somebody else. The plat now before the commission would resolve the encroachment into the rear yard setback once it is moved to the top of the bluff. It would be a protection far the current owner because there is probably a half acre that fits and if someone wanted to rezone, they could build in front of this client's view. Baker reported the court decided that since his client had been using the property, the owner could not restrict him from using it and had to sell it to hirn. • Kebschull noted, in addition, the Borough would not allow transfer without the property being platted. Discussion followed related to who actually owned the property and it was noted the Borough had recorded the individual condominium owners as the owners who were being taxed. It was noted the Borough requires a certificate or title report for this and the signatures on the plat would have to be addressed. BREAK TAKEN: 7:22 P.M. (Kebschull requested the break to research the Code.) BACK TO ORDER: 7:25 P.M. • Kebschull explained, prior to making a decision on the rezone, she wanted to clarify the land was zoned Conservation and within the Land Use Table residential uses were allowed if the land is privately held. • Kebschull added, within those constraints, the development that was already on that lot was asix-family dwelling and was all that would be allowed under the Suburban Residential zone without a conditional use. • Even if the conservation portion was attached and all other setback requirements would be met, one could develop on the portion of the property zoned Conservation. • Requiring the rezone would restrict development more so than allowing the property to remain conservation. (IL) and Suburban Residential to Central Mixed Use Zone {CMU} Legal Description: Multiple Parcels -See Attached Map and Spreadsheet Street Address: Multiple KPB Parcel No.: Multiple Existing Zoning: General Commercial, Central Commercial, Light Industrial, and Suburban Residential Current Land Use: Multiple Uses -Primarily Commercial or Vacant Land Use Plan: Mixed Use, Central Commercial & Airport Industrial ANALYSIS General Information: This is an application by the City of Kenai's Planning and Zoning Commission to rezone a large area in the central downtown area of Kenai #rom General Commercial, Central Commercial, Light Industrial, and Suburban Residential to Central Mixed Use. The Central Mixed Use zone is a zone that was developed at the recommendation of the Commission after numerous work sessions and after reviewing the goals of the Comprehensive Plan to establish such a zone. KMC 14.20.270 describes amendment procedures. The proposed rezone meets the criteria of the code for an amendment to the official zoning map. The proposed rezone area encompasses an area containing 329 parcels, approximately 241.47 acres. The proposed area was decided after a review of the current land uses, the land uses allowed in the Central Mixed Use zone, and the Comprehensive Plan. The Commission held two work sessions to discuss the proposed boundaries for the zone. Notices were sent to all property owners in the proposed area. There was minima! public comment about the proposed rezone. 0708 Conunent.doc Page 2 The Commission recognized that the proposed rezone may inhibit future industrial uses in the area while allowing residential uses not currently allowed in areas presently zoned General Commercial and Light Industrial. Also noted was that there may be uses that would become non-conforming with the proposed rezone; however, those uses would be allowed to continue as anon-conforming use. RECOMMENDATIONS The proposed rezone is the culmination of approximately two years of meetings for the Planning and Zoning Commission. The Commission's goal was to develop an area in the central city area tha# provides for a mix of retail and residential uses. The Central Mixed Use zone was established to provide for such an area. For clarification purposes, administration thought that this plat was formalizing a vacation that was approved in 2005. Mr. Baker has advised that is not the case and that they are starting the vacation process again. In 2005, the 33-foot ROW easement vacation was approved but the City required a 15=foot utility easement. The utility easement is being retained to support a possible future expansion of the City's water system. The water system was constructed on a grid system for future expansion. That system provides for an extension from Highbush Lane to Baker Street in the area of the proposed vacation. Because the vacation process is being initiated again, the Commission's comments will be forwarded to the Borough who will approve or deny the vacation. If the Borough approves the request, the City Council has 30-days to veto that decision. Section KMC 14.25.030 details Landscaping/Bike Plan submittal requirements. This is a landscapelsite plan for the Lowe's Home Improvement Store. The applicant has submitted a site plan showing the proposed building, access, parking, snow storage areas, proposed landscaping, signage and other minor additions #o the development. There are four types of landscaping defined in KMC 14.25,040: a. PerimeterlBuffer Landscaping -involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. The pfan for this development provides far landscaping along all sides of the development including a swale along Marathon Road landscaped with grass and trees. At each access along Marathon Road, there is a landscaped area with trees and shrubs. A landscaped grass area continues along the side and rear of the store along Baron Park Lane. Along the property line abut#ing the properties facing Airport Way, there is a wide landscaped, grassy area coming off Marathon Road. The building will be accessed through a parcel off Airport Way. That access is landscaped with trees along the driveway. The landscaped areas along the property lines meet the minimum 10-foot requirement of KMC 14.25.040 {b){1). Any excavation into the City of Kenai's right-of-ways will require excavation permits from 07-D7 Comment Page 2 the City of Kenai. b. Interior Landscaping -- involves areas exclusive of the perimeter and parking lot areas, There is minimal interior landscaping in this plan. There is a landscaped island in the parking lot on the northern end of the site. The parking lo# restricts further interior landscaping. c. Parking Lot Landscaping -involves areas adjacent to or within parking lots and access drives. As noted, there is minimal interior landscaping due to the size of the parking lot and the need to allow for snow removal. The plan does provide for some landscaped islands in the parking area. d. Street Right-of-Way Landscaping -intent to soften the impact of land uses along rights-of-way but does not obscure land uses from sight. The right-of-way landscaping is described in the perimeterlbuffer landscaping section. The developer is providing for a mix of landscaping materials including: Colorado Green Spruce, Paper Birch, Amur Chokecherry, Canada Red Select Cherry, Quaking Aspen, Hedge Cottoneaster, Dwarf Mugo Pine, Bush Cinquefoil "Gold Drop", Vanhoutte Spirea, Common Purple Lilac, Iris, and grass seed. Kenai Municipal Code 14.25.Q45 identifies the objectives for the site plan. The site plan provided in this application meets the objective of the code. The plan provides for location of the building, access to and from the site, traffic patterns, parking lot layout, snow storage areas, and location for signage. The site provides for B12 standard parking spaces and 12 handicap spaces exceeding the City's parking requirements. The parking lot will be paved. The plan is not to place a dumpster a# this site. The store will have an enclosed trash compacter. If a dumpster is placed on the property in the future, it must be located in an obscured location and screening will be required. Prior to the placement of any dumpster, the location and screening construction must be approved by the City. The Building Official will determine if the sign loca#ion meets the code requirements when the building permit is issued. The site plan shows a sign located at the access off Airport Way. The operators have submitted yearly reports as required by code. The following is a brief report of the 2006 operations: Chester Cane operates under grandfather status. He has several parcels included in his extraction operation. Mr. Cane reported approximately 18,534 cubic yards of material was extracted from this site this past year. Under the grandfather status, Mr. Cone must extract resources in compliance with current code requirements. The report notes approximately 50 percent reclamation has occurred. As noted in prior reports, the pit is leased by S&R Enterprises. The lease does not require a transfer of the Conditional Use Permit. 2. Foster Construction holds permits to excavate from two areas. The oldest gravel pit is located off Beaver Loop Road in the Angler Acxes area. This pit was purchased from Mr. Cone. Steve Foster has reported that this pit is now owned by Angler Enterprises, a corporation formed by the Fosters. There was no activity reported for this pit during 2406. The report estimates approximately 75 percent of the reclamation as complete. Mr. Foster reported that they are planning for a lot of activity during 2007. The second pit permit that Foster Construction operates is located off Beaver Loop Road between the Krogseng and Doyle pits. Steve Foster advised that this pit is now owned by Twin Rivexs Resources with Mr. Foster being the main contact. The report for this pit notes approximately 1.8,600 cubic yards of material excavated this year, estimates 40 Gravel Pit Yearly Reports 7anuary 26, 2007 Page 2 percent of the reclamation as complete, and that approximately 1000 cubic yards of fill was placed in the old extraction area. 3. Pat Doyle, Beaver Loop Sand & Gravel, operates off Beaver Loop Road next to Foster Construction. This pit is operated under grandfather status. Mr. Doyle reports minimal activity this year with approximately 50 cubic yards of material extracted. The report notes that approximately 50 percent of the project has been reclaimed. Mr. Doyle also notes in the report that there is a storage yard at the site for Doyle Construction. 4. Daniel Krogseng, AA Dan's Construction operates off Beaver Loop Road next to Foster Construction. Mr. Krogseng reported approximately 18,820 cubic yards of material was extracted this last year. The report doesn't specify amount of reclamation but notes the reclamation activity as "building a lake." 5. Zubeck, Inc.,operates from two parcels located in Hollier Subdivision. The pits are behind Cone's property. The report notes minimal activity during 2006 with approximately 3,750 cubic yards of material excavated. No reclamation activities took place this year. This site is operated under grandfather status. 5. Michael Pelch operates a pit located off Beaver Loop Road across from the Foster's Angler Acres pit.
