Dear Ms. Kebschull, I live adjacent to the KPCCC center at 310 South Spruce. After reading the application for the permit I have a concern about the buffer that exists between our house and the proposed new buildings. Under the new plan the existing buffer would be eliminated and a new 17 space parking lot and administration building would be constructed 25 feet from the edge of our house. The buffer that would be eliminated is a 30 foot wide strip of land between our house and the existing drive on the north side of the KPCCC property. This strip of land is made of trees and brush and provides a natural boundary between our two properties. T delivered a letter to Tammy Bidwell the Director of the KPCCC facility explaining my concern regarding this buffer. Y offered a couple of options to correct the problem; 1. Move parking spaces 9 through 17 west to the edge of our property line and allow us the opportunity to purchase the 25' strip of land to maintain this buffer. or 2. Build a stone or architectural concrete wall engineered to deflect vehicle and parking lot noise. I have hopes that this issue can be resolved by the meeting scheduled for this Wednesday, May 23rd. As a reminder tonight's meeting is only addressing the modification of the Conditional Use Permit, the landscape/sike plan will be reviewed and approved by administration at a later date. However, the Commission may address additional landscape requirements other than the minimum requirements in 14,25.040. As I told Marilyn yesterday, she needed to voice concerns i.e.. "If the planting plan is dense enough, such as lilac or evergreen hedge, with some local birch and spruce, could we dispense with a fence? I am also concerned with liability far kids getting hurt on a fence." to the Commission so they have them when making their decision. If you need additional information you can call me at 283-8237. One copy of the landscaping/site plan (eleven inches (11") by fourteen inches (I4") size) shall be submitted fox approval to the Administrative Official prior to the issuance of a building permit. If approved, a zoning permit shall be issued and on file in the Planning Department and the Building Official will be notified. The landscapinglsite plan shall be prepared at a minimum scale of one inch {I") equals twenty feet {20'} and shall include the fallowing information: {a) Scientific ar common name or type of planting materials to be used in the project; (b) Typical planting details; (c} Location of all planting areas and relationship to buildings, parking areas and driveways; (d) Identification and location of existing vegetation tb be retained; {e) Identification and location of non-living landscaping materials to be used; (f} Identification of on-site snow storage areas; (g) Drainage patterns; (h) Description~of buildings, including building height and ground floor dimensions; (i) Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property which may restrict development ox drainage. 14.25.040 Landscaping plan-Performance criteria, (a) Objectives for Landscaping Plan. An effective landscaping plan should utilize a variety of techniques for achieving the intent of this section. The appropriate placement or retention of vegetation in sufficient amount will provide the best~esults. Perimeter, interiox, street right-of way, and parking lot landscaping should be included as components of the overall landscaping plan. (b) PerimeterlBuffer Landscaping. Perimeter/buffet` landscaping involves the land areas adjacent to the lot lines within the property boundary. This buffer landscaping serves to separate and minimize the impact between adjacent uses. Buffer landscaping may be desirable along the perimeter of the property to shield vehicular ar building lights from adjacent structures and to provide a visual separation between pedestrians and vehicles. Landscaping adjacent to residential zones shall have landscaping beds that meet all of the following minimum standards: I . Landscaping beds -Minimum of 10 feet in width along all property lines, which adjoin residential zones, exclusive of driveways and other ingress and egress openings. A 6-feet high wood fence or masonry wall may be used in place of 5 feet of the required bed width. 2. Ground cover - 100 percent within 3 years of planting and continuous maintenance so there will be no exposed soil. Flower beds may be considered ground cover. 3. Trees andlar shrubs appropriate for the climate shall be included in the landscaping beds. (c) Interior Landscaping involves those areas of the property exclusive of the perimeter and parking lot areas. Interior landscaping is desirable to separate uses or activities within the overall development. Box 468, Soldotna, Alaska. City Planner Kebschull noted the following: • Approval of the plat would remove three lot lines to create on large parcel containing approximately 4.252 acres. Removal of the lot lines is being requested to plan for additional development and to eliminate non-conforming structures that had been built across the lot lines. • The subdivision is served with municipal water and sewer. • The plat would dedicate a 25--foot right-of-way dedication along Char Circle as a result of discussions with the City who owns the adjoining parcel. City Administration believed future development would result in a vacation of the current half-dedication. • The City would not be requiring development of Char Circle with this plat. • No installation agreement is required. • The City Engineer noted the existing entrance to the parcel is in the ' platted right-of--way. When the parcel to the south is developed, the City would complete the development of the right-of--way. • The Building Official noted the removal of the lot lines would eliminate building code issues. Kebschull noted the following: • Referred to the memorandum included in the packet explaining the proposed ordinance to amend Chapter 11 of the Kenai Municipal Code and eliminating the Harbor Commission and reassigning its duties. • Explained the format and items that would involve the Planning 8a Zoning Commission. • Commission was requested to review the proposed ordinance and their comments would be provided to City Council. • Council Member Ross noted there would be ample time as the proposed ordinance had not yet been introduced at Council. City Council -- Ross provided a brief report on actions taken at the May 2, 2007 City Council meeting. 9-b. Borough Planning -- Commissioner Bryson advised there had been no meeting since his last report. 9-e. Administration -- Kebschull noted the following items: • A copy of the new Airport Supplemental Plan, Phase II was provided to each Commissioner and a hard copy was available at the airport as well as City Hall. • She will be absent from the May 23 meeting due to training in Anchorage, however Department Assistant Carver would be in attendance. • Soldotna is reviewing their comprehensive plan. • Referred to the Peninsula Oilers letter included in the packet and explained the Conditional Use Permit had not been used in the past two years and they have no plans to use it in the future. The record from 19$0 states, "Mrs. Hardy pointed out that there would be two residential houses placed on the land..." The resolution approving the Conditional Use Permit noted in Finding 4, "This use is similar, although not identical, to both "one and two family dwellings" and to "hospitals and sanitariums", and thus could meet the "use similarity" test." A copy of the minutes and resolution from that meeting are attached. Since the original permit was issued, two residential structures were built on the site as well as an administration building. The group has now received funding to construct an additional administration building and a gymnasium for their facility. Because this is an expansion of the use, even though the proposed buildings will support the approved facility, the City has requested that the permit be modified to incorporate the additional structures as well as any additional support facilities. 0716 Camment.doc Page 2 This is a private facility and not opened to the public. Adolescents placed in the facility are protected under confidentiality rules. Because of these constraints, the City has reviewed the proposed facility additions, recognizing the limited use of the facilities, believes it in the best interest to not require the structures to meet the parking requirements for a public facility. For a public facility with the current structures and proposed structures, S9 parking spaces would be required. The administration building would require 16 spaces, the two residences require 4 spaces, and the gymnasium would require 39 spaces. The site plan provided with the application shows 2S spaces and the group believes this more than meets the needs of the facility. City Engineer: Expansion of the facility should not adversely impact traffic patterns. As a site plan is developed, administration will address other issues. Building Official: The proposed building will be reviewed for compliance with building codes. RECOMMENDATIONS KMC 14.20.1 SO details the intent and application process for conditional uses, This is a modification of a permit that was issued in 1980. The facility has grown and the need for an additional administrative facility and gymnasium has been identif ed. Because of the type of facility, the adolescents placed there often live, attend school, and receive counseling, and recreational activities at the site. These new facilities will meet the demands far these services. This facility is located on a parcel over 4 acres in size. This site is large enough to accommodate the additional facilities while maintaining a buffer from other properties adjoining the site. Recommend approval of the modification of the PZ80-07 noting that: 1. The facility will not be required to meet the parking requirements for a public facility. 2. Discussion: F.B.O. Lots 1-3, Stoehner's Lease Ben Delahay explained the background and what has txanspired at tha City Council level concerning this lease application. He stated that the lots were approved for lease by the Council, • but the Stoehner's wanted an amendment to the lease so that it would begin July 1st. The Council agreed to go half way on the time, but their attorney stated that this would not be acceptable, so they have no lease. Mr, Delahay painted out the memo which he had written to the Council concerning this lease, and in which he offers them four alternatives. Applicant has purchased the apartment complex located at 412 North Forest Drive. This is an established apartment complex that was recently purchased and renovated by the applicant. The applicant has purchased a new sign #or the refurbished complex and when obtaining a sign permit realized that the previous sign had been placed in the right-of-way and not a'n the subjec# property. Within the constraints of the development and while trying to make the sign as visible as possible, the applicant has requested a 9.5 foot setback variance. The code requires that signs for this type of permitted use be placed 10-feet back from the property line. Forest Drive is a 100-foot right-of-way. The sidewalk is approximately 27-feet from the subject property. Placing the sign .5 feet from the applicant's property line should not create a safety hazard and should not impede snow removal. D7i7 Comment.doc page 2 KMC 14.20.180 details the intent and application process for Variance Permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shalt establish a finding that alt of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. This is a large apartment complex That was originally built in 9978. When the complex was built, if is assumed that the developers did not realize fhe size of the right o!"way. There are no other similar developments along North Forest Drive. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. The applicants recently purchased this property and during renovation removed the complex sign. When seeking a permit to replace the sign, it was discovered that the previous sign had been in the right- of-way. Applicants are seeking a remedy fo place a sign for the complex within the constraints of their developed property and visible from the main street, North Forest Drive. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. The sign is a permitted sign in the Suburban Residenfial zone. 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. if could be questioned whether a 9.5 foot variance is fhe minimum variance to provide signage for the apartment camplex. However, due to the age of the development and size of the Forest Drive righf-af--way, fhe requesfed variance should not affect traffic or other properties in the area. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. The requested variance is not based on other non- conforming structures in the area. City Engineer: The proposed sign location should not create aproblem. An as-built certification for the home .shows the studio, located above the garage, with an approximate square footage of 298 square feet. This home is approximately 3,57$ squaxe feet with a 576 square-foot garage. The area proposed for the home occupation meets the requirement of not using more than 30 percent of the grass floor area of the buildings on the lot. Applicant does not plan on having anyone outside of the home being employed in the photography studio. Appointments will be required. There is sufficient off-street parking for the proposed photography studio. Based on the information provided, the proposed photography studio meets the requirements for a home occupation. RECOMMENDATIONS Applicants are proposing to operate a photography studio from their residence. Clients will be required to schedule appointments. There is sufficient off-street parking for the studio in addition to that for the residence.
