SUBJECT: PZ06-41 -Conditional Use Permit -Restaurant & Catering
510 Upland Street
This Conditional Use Permit was approved on June 14, 2006. Kenai Municipal Code
14.20.150 (i)(1) states, "An approved conditional use permit lapses twelve (12) months
after approval if no building permit is procured or if the allowed use is not initiated." This
property is located in the Townsite Historic zone and the applicant has been working to
develop a plan for approval within this zone. The code does allow the Commission to
grant time extensions not to exceed six (6) months upon a finding that the
circumstances have not changed sufficiently to warrant reconsideration of the approval
of the permit (KMC 14.20.150 (i)(2)). The request for extension must be submitted prior
to the expiration of the permit. A public hearing is not required.
Sandra Vozar-Givanan submitted a request, in writing, on June 12t'' prior to the
expiration of the permit. Ms. Vozar-Givanan states that the original plans for the
development have not changed.
It appears the requested extension meets the requirements of KMC 14.20.150(1)(2).
Recommend the Commission grant the extension to December 14, 2007.

A draft ordinance has been prepared to recommend amending KMC 23.20.030 to
better describe and define what constitutes prohibited storage of "junk,"
"garbage," and "litter." Attached is a copy of the current code, draft resolution
and draft ordinance. Please review these documents. If you would like to
suggest amendments, the information will be provided to the City Attorney for
consideration. A public hearing has been scheduled for the Planning and Zoning
meeting of Juiy 11tH

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING TO THE COUNCIL THAT KMC 12.20.030 BE
AMENDED BY BETTER DESCRIBING AND DEFINING WHAT CONSTITUTES
PROHIBITED STORAGE OF "JUNK," "GARBAGE" AND "LITTER" UNDER THE CITY
CODE.
WHEREAS, KMC 12.20.030(a) currently prohibits the keeping of various kinds of debris and
junk on property within the City of Kenai; and
WHEREAS, the City Code does not provide a precise definition of what constitutes "garbage,
"junk" or "litter"; and
WHEREAS, better definitions and descriptions of prohibited activity are needed in KMC
12.20.030; and
WHEREAS, it is in the best interest of the City of Kenai to amend KMC 12.30.030.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDS THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMEND
KMC 12.20.030 as follows:
12.20.030 Debris and junk prohibited.
(a} ENO OWNER, LESSEE, AGENT, TENANT, OR OCCUPANT SHALL
ALLOW OR PERMIT ANY DEBRIS, JUNK, OR INDISCRIMINATE
STORAGE OF MACHINERY, EQUIPMENT PARTS, LUMBER, OTHER
MATERIAL, OR ANY ACCUMULATION OF GARBAGE, MANURE,
OFFALS, RUBBISH, STAGNANT WATER, OR ANY FILTHY LIQUID OR
SUBSTANCE, OR ANYTHING THAT IS OR MAY BECOME PUTRID OR
OFFENSIVE TO BE OR REMAIN UPON HIS YARD, LOT, OR PREMISES,
OR UPON ANY YARD, LOT, OR PREMISES OWNED OR CONTROLLED
BY HIM.] The owner and the occupant of andprivate property in the city shall at
all times maintain the premises free from significant accumulations of junk,
ag rbage or litter; provided, however, that this section shall not prohibit the storage
of iunk_or litter in authorized_private receptacles for collection, or the storage of
junk that is not visible to the public at large. A significant accumulation of junk
or litter an anKprivate property in the city contrary to this section is deemed to be
a public nuisance.
(b) No owner, lessee, agent tenant or occupant shall allow or permit slash to
be or remain upon any lot: 1) for longer than one hundred twenty (120) days
within the RU, RS1, RS2, TSH, CC or CG zones; or 2} fox longer than one

hundred twenty (120) days on lots smallex than forty thousand (40,000) square
feet within the C, RR, RS, IL, IH, R or ED zones.
~ Nothing_in this chapter shall be construed to limit the lawful operation of a
iunkyard or storage yard. This section does not amend, alter or modi~ the
rovisions of KMC 12.25 abandoned vehicles .
As used in this cha ter the followin words are defined in this section:
"Gaxba e" means all utrescible wastes exce t sewa e and bod waste includin
food wastes. resulting from the handling=preparation, cooking, or consumption of
food or the cans, containers, wrappers, or other tan ibg Ie items,wasted or used
alon with such materials."
"Junk" means an worn-out wrecked scra ed artiall or full dismantled or
discarded tangible material, combination of materials or items that cannot without
further alteration and reconditioning be used for their original ~urf?oses, including
but not limited to a liances buildin material chemicals e ui ment fiunituxe
machinery, metal, rags, rubber, paper, used tires, plastics and wood,
"Litter" means all improperly discarded waste material, including but not limited
to convenience food, beverage and other product packages or containers
constructed.of steel, aluminum,_~lass, paper, plastic and other natural and
synthetic material, thrown or deposited on the lands and waters within the
boundaries of the city.
"Occu ant" means the erson in ossession of the real ro ert on which the 'unlc
or litter is located. "Occupant" includes tenant and lessee.
"Owner" means the owner of the real property an which the junk ox Iitter is
located, or the agent of the owner.,

timber. Tree trunks trimmed free of roots and branches or cut f rewood stacked
and separated from branches and other residue of txee cutting shall not constitute
"slash."

The propose of this correspondence is to submit for your review and comment the above
referenced lease application.
The Airport Commission reviewed the application at their June 14~~' meeting. They
agreed with Administration to approve the lease application for an initial term of 35
years, with a lessee option fora 20-year renewal.
At their June 20`h meeting, City Council approved Resolution No. 2007-40 authorizing
Arctic Barnabas Ministries, Inc. the contractual right fora 20-year lease renewal fora 35-
year lease.

SUBJECT: Lease Application -Arctic Barnabas Ministries, Inc.
Lot 9A, Block 5, General Aviation Apron Subdivision No. 5
have reviewed the lease application submitted by Arctic Barnabas Ministries,
Inc. as required in KMC 21.10.070 (3). The applicant is proposing to build an
80'X100' hangar with a 44'X80' officelcoffee shop space. This property is
located on the corner of North Willow Street and Granite Paint Street. This
property is located in the Airport Reserve.
Airport Land Use Plan - A limited ALP was completed in December
2006. On sheet 10 of that update, the property is shown as
undeveloped, subdivided lots and zoned IL -Light Industrial.
Sheet 11 of the updated ALP, identifies the parse! as GA (General
Aviation) and Light Commercial. The Supplemental Plan defines
General Aviation and Light Commercial as, "Areas used by general
aviation and light commercial aviation activities requiring taxiway
access to the paved runway. Uses shall be restricted to aircraft
meeting taxiway pavement strength limitations and taxi lane and
taxi lane object fee area width standards defined in FAA Advisory
Circular 15015200-13." The proposed hangar will house the
headquarters for a ministry operation and to store and work on
aircraft used in the ministry. It appears the proposed use conforms
#o the Airport Land Use Plan.

Comprehensive Plan -The City of Kenai Comprehensive Plan
Land Use Plan identifies this area as Airport Industrial and within
the proposed Airport-Dependent Development District. The Airport
Industrial area is defined as, "The Airport Industrial district identifies
airport lands reserved for the Kenai Municipal Airport and its future
expansion, and tracts needed for present .and future aviation-
related uses and activities. The proposed use conforms to the
Comprehensive Plan. The proposed Airpork-Dependent
Development District has not been es#ablished.
Zoning The property is zoned IL --Light Industrial. Airports and
related uses are permitted within the zone thus the proposed
hangar meets the zoning. Restaurants, professional offices, and
retail businesses are also permitted within the zone. The proposed
office and coffee shop meet the zoning.
Future Airport Improvement Projects - There.are no airport projects
planned in this area at this time.

and the proposed development appears to meet all requirements.

Facility will be a storage and maintenance facility for aircraft used in their
operations. The coffee shop appears to be a minor part of the facility.

Land Inside the Kenai Municipal Airport Reserve
2. NARRATIVE:
Arctic Barnabas Ministries Inc. proposes to build an aircraft hangar with offices and public-use
coffee shop facility on Lot 9A Blk-5, located on the SW corner of Granite Point Street and North
Willow Street (located at Kenai Municipal Airport, Latitude N60° 33' 45" Longitude 151° 14' 40"}.
The proposed construction period is June 2007 through December 2009. Estimated cost of the
proposed project is $1.S million. The construction is to be a metal building which includes an 80' X
100' hangar with an attached 44' X SO' office/coffee shop space. Street access will be from North
Willow Street and from Granite Paint Street.
A. Explain haw the proposed use and development of the property wi!! conform to the Zoning
Ordinance of the City.
Subject property is zoned Light Industrial. Airports and Related Uses, Professional Offices, and
Restaurants are Principal Permitted Uses for an area zoned IL. Additionally, the IL zoning is
intended for development of industrial and commercial uses which are compatible with surrounding
property, and that will not introduce any nuisance effects to the area. Principal uses of the facility
will involve working on and parking of aircraft used in the business, housing professional offices of
the organization and a small coffee shop. These features appear to be compatible with other
businesses and facilities in the area. (Reference: City of Kenai Zoning June 2006 map; KMC
14.20.130 Light Industrial Zone; 14.22.010 Land Use Table)
KMC 14.20.130 Light Industrial Zone states that restrictions against noise shall not apply to uses
located within two thousand (2,OOOj feet of the airfield landing strip. The facility is located within
that measurement boundary, so operation noises will be within parameters of the municipal code.
I~MC 14.20.130 states that no open storage shall be located closer than twenty-five feet (25') to the
adjoining right-of--way of any collector street or main thoroughfare, and if visible from a collector
street or main thoroughfare, it shall be enclosed with an eight-foot (8') high fence of goad
appearance acceptable to the Commission. A dumpster will be located on the SW corner of the
building,. away from any collector street or main thoroughfare, as shown on site plan.
The residential buffer described in KMC 14.20.130 is not required for this facility, as the subject
property does not abut a residential zone.
The requirements of KMC 14.25.040 Landscaping plan ~-Performance criteria, will be met by the
intended landscaping as shown on the site plan. All trees and four feet of overburden will be removed
from the site. Trees or shrubs and grass will be replanted as a buffer between the proposed ABM
project site and the business located to the south. Areas of the site that are not along a street right-of-
way will have gravel, grass, ar cement. There will be pavement on the outside of the fence in the
parking area, wi#h grass and shrubs in planting areas.
Parking for the facility complies with KMC 14.24.250 Off-street parking and loading requirements.
According to square footage/seat requirements, 8 spaces are required far the hangar portion, 4 spaces
far the hangar off ce area, 6 spaces for the coffee shop, 1 space for the barista, and 16 spaces for the
professional offices, for a total of 35 required spaces. If the individual parts of the facility are
considered under the Joint Parking Areas code, then 75% of that number is required for a total of 27
spaces. 35 parking spaces are shown on the site plan. As required, 2 spaces will be handicap parking.

Parking spaces are planned on the same lot as the proposed building, and will have asphalt to meet
the requirements of being durable, well-drained, and dust-free, with bumper guards for each parking
space along the building. The designated parking and loading areas will only be far their designated
uses.
No special lighting is planned for parking areas; there will be the existing street lights, and
architectural lights on the building.
There will be driveway curb cuts off Granite Point Street and driveway curb cuts off North Willow
Street; the curb cuts are situated to avoid creating traffic hazards.
There is one 20' x $0' off street loading area planned and shown on the site-plan. It is located on the
driveway off Granite Point Street.
KMC 14.20.200 Accessory structures. There are no accessory structures which will extend into
setbacks ar outside the parameters listed in the zoning code.
Signage is yet to be determined, but will comply with KMC 14.20.220 Signs.
B. Explain how the proposed use and development of the property will conform to the
Comprehensive Plan of the City.
The Comprehensive Plan of the City encourages development of facilities that are aviation-related on
airport lands. Aircraft and aircraft-related activities are an integral part of Arctic Barr~abas Ministries
operations to be housed in the facility, and make it a viable airport-dependent development.
C. Explain how the proposed use and development of the property will conform to the latest
FAA-approved Airport Layout Plan for the Airport.
The facility complies with Sheet 1 of 13, Kenai Municipal Airport Layout Drawing. The proposed
facility will fit within the building restriction lines.
D. Explain how the proposed use and development of the property will conform to the latest
Land Use Plan for the Airport.
The subject property is zoned GA and Light Commercial on Sheet 11 of 13 of the latest FAA-
approved Land Use Drawing. The proposed facility meets requirements for Kenai Municipal Code
14.20.130 Light Industrial Zone {IL Zone), an approved Pxincipal Permitted Use far this zoning. The
facility will be a metal building which includes an $0' X 100' hangar with an attached 44' X $0'
office space. Height of the building will be 2$' with a 20' VHF radio antenna mounted on the roof,
for an approximate overall height of not mare than 4$'. This height is within the limitations set by the
current FAA-approved Kenai Airport Master Plan drawings. It will be the headquarters for a ministry
operation, and will primarily be used to store and work on aircraft used in the ministries of the
organization, professional office operations and apublic-use coffee shop. Street access will be from
North Willow Street and from Granite Point Street.

Statement of Purpose
Arctic Bamabas Ministries, Inc. (ABM) is a SO1(c)(3)non-profit
corporation that controls and operates such business activities as are
promulgated by its Board of Directors. It was incorporated in 2000 in
the State of Alaska, and exists to provide leadership training, practical
support and encouragement to ministry workers, primarily in Bush
Alaska.
Because the focus of ABM is on providing services to those who are
off road in the Arctic, owning and operating aircraft is critical to the
functioning of the business. For this reason, we propose to lease
property on the airport in Kenai to build the ABM headquarters,
which will include the necessary aircraft hangar facility and
professional office spaces.

Description of the Business
Arctic Bamabas Ministries, Inc. was started in 2000 under the
direction of Joel and Gail Caldwell. It is anon-profit corporation,
financed entirely by individual and business donors and churches who
support ABMs stated purposes and strategies. Tts governance is vested
in the ABM Board, and the property, activities and business of the
Corporation is managed under its direction.

Location
As stated in the Articles of Incorporation, the principle office of the
Corporation shall be located in the City of Kenai, Kenai Peninsula
Borough, Alaska. At this time ABM leases aircraft hangar and office
space from SOAR International Ministries, located at 13S Granite
Point Court, Kenai, Alaska. The property is zoned General Aviation
and Light Commercial/Industrial, as is the proposed lease site on the
corner of North Willow and Granite Point Street.
Facility and Space Requirements
In keeping with the comprehensive plan for the City of Kenai, this
business is strongly aviation-related and airport-dependent. Currently
there are two primary aircraft that are owned by, or related to
operations of, ABM. Expansion of the aircraft fleet will require more
aircraft hangar space than what is available right now.
The current staff is at eleven {11) full-time employees involved in
carrying out the primary mission statement and functions of the non-
profit corporation. Staff ng is expected to remain at this level through
.Ianuary 2009. The office space presently occupied has reached
maximum capacity.
The planned building project will add the much needed space for the
aircraft and staff, and will be an attractive and viable aviation-related
business addition to the Kenai airport lands and surrounding business
community.
