Jason Steen, Cade Enforcement Officer, City of Kenai - Esannples of Code Complaints (Debris 8s Junk) Steen noted his address as 328 Portlock Street, Kenai and gave a presentation of examples of junk and litter complaints he has investigated in the past three months. "GCl" 907-595-3605 2550 Denali Street, Suite 1000 Anchorage, Alaska 99503 Property Owner: Kenai Peninsula Borough 144 North Binkley Street Soldotna, Alaska 99669 Requested Action: Conditional Use Permit -Communications Tower (Cell Site) Legal Description: Tract B, Alaska State Land Survey 79-57 Street Address: 2415 Redoubt Avenue KPB Parcel No.: 04301026 Existing Zoning: R -Recreation Current Land Use: Commercial Use Land Use Plan: ConsenrationlOpen Space ANALYSIS General Information: -- The City of Kenai has received a building permit application from General Communication, Inc. "GCI" to demobilize and remove an existing 100' guyed (cable- supported) tower and to build a new 180-foot self-supporting steel tower. During the review of #his application, it was discovered that the existing tower is considered a non- conforming use. Based on the City's records, the tower was built in 1969 prior to the City`s enactment of Zoning in June 1984. (See attached documentation.) The property is zoned Recreation. The Land Use Table now lists RadiolTV Transmitters/Cel! Sites as Conditional Use in the Recreation zone. Due to the non-conforming status of the use, the applicant must apply for a Conditional Use Permit to obtain a building permit. KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. The intent of the Recreation Zone is intended to contain both public and private lands to be utilized for commercial and non- 0740 Comment Page 2 commercial recreation and residential purposes. Lands designated for this district should be evaluated far Lang-term public benefifs fo accrue the protection offered by this designation. This is anon-conforming use that has existed since 1969. The Cify assumed zoning powers in 99$4. In 99$4, the property was shown as Recreation on fhe zoning map; however, the code did not lisf a Recreation zone. Because fhis is a continuation of a non-conforming use for a ufility that has provided long-term benefit to the community, it appears the use meets the purpose of the chapter. 2. The value of the adjoining property and neighborhood will not be significantly impaired. The proposed upgrade of fhis communications tower should not significantly impair the adjoining property since the site has existed since of least 9969. 3. The proposed use is in harmony wikh tine Comprehensive Plan. The Comprehensive Plan identifies the area as "Conservation/Open Space." "The Conservation districf applies fo public lands whose primary use is open space, recreation, fish and wildlife habitat, drainage ways, floodplain, and wetlands. Some public improvements may be appropriate within design guidelines." The upgrade to this site will not involve any clearing of existing trees and will be located in the area already cleared for the use. Because the use has been in existence for so many years, if appears the Comprehensive Plan designation would be more appropriate for vacant lands and not existing developed parcels. The use existed prior fa fhe 2003 Comprehensive Plan and that should be considered when determining if the use is in harmony. The use appears to meef the intent of the Plan for developed parcels. 4. Public services and facilities are adequate to serve the proposed use. Public services are adequate for the proposed use. 5. The proposed use will not be harmful to the public safety, health or welfare. The proposed use will not be harmful fo public safefy, health, or welfare. The applicant is in the process of obtaining approval from the FAA for fhe tower due to its height and proximify to the airport. The Telecommunications Acf of 7998 states, "No State of local government or insfrumentalify thereof may regulate the placement, construction, or modification of personal wireless service facilities on the basis of environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission regulations concerning such emissions." There is no information that the proposed use is harmful. See attached. 6. Any and all specific conditions deemed necessary by the commission to fulfil! the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. There is a 8-foot chain link fence around the fowers as well as natural vegetation and shrubs throughout the property. There does not appear to be any special conditions necessary to allow the construction of the new tower. City Engineer: Provide proof of FAA review for airspace. Building Official: No building code issues. 0740 Comment RECOMMENDATIONS Page 3 GCI Communications Corporation leases this site from the Kenai Peninsula Borough. GCI has a cell tower at this location that needs upgraded. Based on the City`s records, the tower has been in this location since 1969 and prior to the City assuming zoning powers. The property is located in the Recreation zone and under current zoning communication towers require conditional use permits. Due to the need to upgrade the site and obtain a building permit. The application is now applying for a Conditional Use Permit. Recommend approval with the following requirement: 1. Land use boards need to take notice as well. In rewriting the rules governing the telecommunications, Congress has included a section on zoning for wireless communications facilities, such as cellular towers. The Act was signed into law on February 8, 1996. Telecommunications Act of 1996 (5.652) Section 704 FACILITIES SITING; RADIO FREQUENCY EMISSION STANDARDS. (a) NATIONAL WIRELESS TELECOMMUNICATIONS SITING POLICY- Section 332(c) (47 U.S.C. 332(c)) is amended by adding at the end the following new paragraph: . '(7) PRESERVATION OF LOCAL ZONING AUTHORITY- '(A) GENERAL AUTHORITY- Except as provided in this paragraph, nothing in this Act shall limit or affect the authority of a State or local government or instrumentality thereof over decisions regarding the placement, construction, and modification of personal wireless service facilities. '(B) LIMITATIONS- '(i) fihe regulation of the placement, construction, and modification of personal wireless service facilities by any State or local government or instrumentality thereof-- '(I) shall not unreasonably discriminate among providers of functionally equivalent services; and '(II) shall not prohibit or have the effect of prohibiting the provision of personal wireless services. '(ii) A State or local government or instrumentality thereof shall act on any request for authorization to place, construct, or modify personal wireless service facilities within a reasonable period of time after the request is duly filed with such government or http: / /njpo. org/features/wireless/ sec704.htm 7/ 17/2007 Telecommunications Act of 1996 on Zoning for Mobile Communications Page 2 of 3 instrumentality, taking into account the nature and scope of such request. '{iv) No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions. '(v) Any person adversely affected by any final action or failure to act by a State or local government or any instrumentality thereof that is inconsistent with this subparagraph may, within 30 days after such action or failure to act, commence an action in any court of competent jurisdiction. The court shall hear and decide such action on an expedited basis. Any person adversely affected by an act or failure to act by a State or local government or any instrumentality thereof that is inconsistent with clause (iv) may petition the Commission for relief. '{C) DEFINITIONS- Far purposes of this paragraph~- '{i) the term 'pcrsonai wireless services' means commercial mobile services, unlicensed wireless services, and common carrier wireless exchange access services; '(ii) the term 'personal wireless service facilities' means facilities for the provision of personal wireless services; and '(iii) the term 'unlicensed wireless service' means the offering of telecommunications services using duly authorized devices which do not require individual licenses, but does not mean the provision of direct-to-home satellite services (as defined in section 303(v)).'. {b) RADIO FREQUENCY EMISSIONS- Within 180 days after the enactment of this Act, the Commission shall complete action in ET Docket 93-62 to prescribe and make effective rules regarding the environmental effects of radio frequency emissions. Upon checking into the complaint, it was discovered that a building permit had not been obtained, the building is encroaching into the front setback, and the parcel is located in the Townsite Historic zone. The owner of the property was contacted and brought in applications for a building permit, an encroachment permit and an application for review in the Townsite Historic zoning district. Setbacks in the Townsite Historic zone are: Front 10 Feet Side 5 Feet` Rear 10 Feet` `Except that for each story over two (2) stories, each side and rear yard shall be increased three (3) feet, but need not exceed fourteen {14} feet for each side yard and nineteen {19} feet for rear yard. Robert Springer, the City's Building Official visited the site with Mr. Cherrier. 0742 Gomment.doc Page 2 Based on an asbuilt from a street project, Mr. Springer and Mr. Cherrier were able to determine the shed encroaches 4-feet into the required front-yard setback. Alaska Avenue "dead ends" at this parcel and is used as access to the recreational vehicle park. There is sufficient off-street parking for the parcel. The building meets the separation distance required in the zoning code for separation between buildings. KMC 14.20.185 details the definition, intent, and permit application process for Encroachment Permits. Code also lists the review criteria that should be considered by the Planning and Zoning Commission when determining if a permit should be granted. The Commission is to establish that the following conditions exist before issuing an Encroachment Permit: 1. An encroachment as defined in KMC 14.20.185 (a) exists. "Encroachment means any object or structure above or below ground and constructed or located in a manner other fhan set fo-th in the Development Requirements Table." The shed is built into fhe fronf setback. 2. The encroachment does not encroach upon a Federal, State or City right-of-way or utility easement. The shed does not encroach into aright-of-way or easement. 3. The owner of the property was contacted and brought in applications for a building permit, an encroachment permit and an application far review in the Townsite Historic zoning district. Kenai Municipal Cade 14.20.105 (h) requires the Commission to review all building permit applications for properties included in the Historic Preservation Plan. This property was identified in the Tawnsite Histaric Survey as a historic property and is listed as Alaska Historical Resources Survey KEN-273 (AHRS# KEN-273). The property is known as the "Ray Gee House." Attached is a copy of the information relating to the property from the survey. The applicant did not obtain a building permit prior to construction. This is a large storage shed (320 square feet}. The building has been finished in an 0743 Comment.doc Page 2 attempt to match the historical structure with green painted siding and a red roof. Storage sheds are a permitted accessory uses in the zone. The applicant did not provide schematic plans of the shed; however, the Building Official has verified that the building meets the building code as constructed. Prior to the discussion, the Commission requested staff send out information on the possibility of a rezone to the Angler Acres area. Also included in the request was to send the information to the South Ames area and there was some discussion about possibly including that area in the proposed rezone. A notice was sent to 66 property owners in those areas. The majority of the response received was from the South Ames residents who were against the rezone. The South Ames area included only has two long-time conditional use permits. One is a CUP issued in 1999 for a welding business {Miller) and the other is for a B&B and guides service issued in 1988 (Smith). When discussing the possibility of the Commission initiating the rezone, the Commission agreed that with the large amount of conditional uses in the area, the area is incorrectly zoned. However, the Commission decided that the property owners should initiate the petition. At every opportunity, I have encouraged these owners to get together to initiate the rezone. There are 18 active conditional use permits on Angler Drive. Attached is a report showing the information for those permits. Monitoring these permits has become very difficult due to the number of permits and the level of activity. In the last week, there have been three separate incidents that have required staff time. Even at that, it is near to impossible to actually determine who is in violation of Memo -Angler Acres Page 2 their conditional use permits. Attached are copies of the most recent letters sent in response to possible code violations on Angler Drive. In addition, to obtain the yearly certificate of compliance documenta#ion requires a tremendous amount of time. It is rare #hat the first letter sent is responded to and usually to obtain the documentation takes several letters and phone calls. When the Commission discussed the possibility of the rezone, the Recreation zone was considered. Conditional uses now operating in the area include: Guides, Cabin Rentals, Hotels, B&B, and Lodges. Within the Recreation zone, all of theses uses are permitted with the exception of Hotels and Motels. Bed & Breakfasts also require a Conditional Use Permit, which is similar in all zones except the Central Mixed Use zone where B&B's are permitted. The City of Kenai's municipal code regulates the use of recreational vehicles. It is hoped this letter will clarify the City's code for recreational vehicles. You may not rent space to anyone to park their recreational vehicle without a Conditional Use Permit for a recreational vehicle park. On private property, the use is limited under KMC 14.20.245 {d}(3): {d) Prohibited Use of Recreational Vehicles. No person may occupy or utilize any recreational vehicle as living quarters or sleeping accommodations under any of the following conditions: (3) While such vehicle is parked on private property and set up for long-term use. Long term use includes, but is not limited to, connection to external fuel tanks or natural gas, skirting in, connection to water, sewer, electrical or natural gas, or exceeding thirty (30) consecutive days. If your lot does not contain a principal structure (residence), the code further restricts use of recreational vehicles under KMC 14.20.245 (d} (4): (4) While the recreational vehicle is parked on private property with no principal permitted structure located on the property, except as otherwise allowed in KMC 14.20.245(e). Violations of the City's code could result in fines of up to $1000 per day per violation. If you hold a Conditional Use Permit to operate a business in this area, allowing clients to camp on your property could jeopardize your permit. On July 23, 2007, Mr. Rogers submitted a new landscapelsite plan. That plan appears to meet the requirements of the code. The plan shows the parcel, cleared areas, location and size of proposed building, snow removal area, drainage, parking area, and driveway. A dumpster is shown on the site plan. It is noted that the dumpster will be provided when the building is leased. The parking area is shown as 40'X100' far a total of 4000 square feet. Four parking spaces are required and this area is more than sufficient for off-street parking. The driveway and parking areas should accommodate large trucks far the warehouse as required in KMC 14.20.250(7). The driveway, parking areas and cleared area around the building will be covered with gravel. Landscaped areas are shown along the northwest corner of the cleared area of the lot, an area along the Kenai Spur Highway right-of-way, and the Eagle. Street right-of-way. Landscaping is identified as Blue Spruce spaced approximately 20-feet apart.
