Planner Kebschull reviewed the resolution in the packet, noting the motion to approve
PZ07-50 and the motion to amend (changing Mini Storage and Storage Yard from "C"
(conditional use) to "N" (not permitted) within the Recreational Zone and changing
Mini Storage from "C" (conditional use) to "N" (not permitted) within the Townsite
Historic District) were active.
Wells reviewed the rules and opened the meeting for public comment. There being no

Barry Eldridge, 2679 Bowpicker Lane -- Distributed .a copy of a letter he wrote to
Kebschull in the fall of 2005 (copy included suggesting changes to the Kenai
Municipal Code; spoke in support of the Preservation Plan, noting more responsibility
would fall to the Planning & Zoning Commission; and added, he believed the Kenai
Municipal Code did not provide encouragement to create buildings to fit into the
Historical Townsite.
George Ford, 526 Ash Arrenue, President; Kenai Historical Society -- Thanked the
Commission for allowing the Historical Society to participate in the update of the
Historic Preservation Plan. Fard spoke in support of the resolution.
Becky Tromhlee, S I.0 Mission -- Spoke in opposition to the resolution, noting she did
riot want any large commercial buildings within Old Town and referred to the issue of
Veronica's Coffee House "stealing" land from the Russian Church. Kebschull noted
the issue was a civil matter between the parties and the city was not involved.

Kebschull reviewed the draft ordinance, noting the amendment would clear up a "gray
area" in. the Cade making owners responsible for garbage containment and collection,
reported the City Council requested comments from the Commission regarding the
amendment, and, action did not need to be taken.
Commissioner comments included:
• Agreement with the amendment.
• It was realistic to require owners to be responsible for garbage
containment and collection.
• Problems would be addressed through the Code Enforcement Officer.

be included in the amendment as some condominiums may not have condominium

SUBJECT: Code Amendment -KMC 9.10.005 and KMC 9.10.020
Council requested the Planning and Zoning Commission review the proposed
amendment to Title 9. At their meeting on October 10, the Commission
discussed the proposed amendment. The Commission agreed that the property
owner or agent of the property should be responsible for providing garbage
containers and garbage service. They felt that the proposed ordinance would
provide clarification for responsibility if there were code violations. They did note
that under section 9.10.020 that there are not always condominium associations
established with condominiums.
The Commission asked that the item be placed on the agenda for their meeting
on October 24th, 2007 in case they had any additional comments. If additional

SUBJECT: PZ06-65 --Conditional Use Permit -Cabin Rentals

This Conditional Use Permit was approved on October 11, 2006. Kenai Municipal Code
14.20.150 (i)(1) states, "An approved conditional use permit lapses twelve (12) months
after approval if no building permit is procured or if the allowed use is not initiated." The
code does allow the Commission to grant time extensions not to exceed six (6) months
upon a find'mg that the circumstances have not changed sufficiently to warrant
reconsideration of the approval of the permit (KMC 14.20.9 50 (i){2)). The request far
extension must be submitted prior to the expiration of the permit. A public hearing is not
required.
Katherine Fleck has submitted a request, in writing, to extend the permit for six {6}
months. The original plans for the development have not changed. Ms. Fleck notes in
her letter the probability that she will need to request another extension in six (6)
months. The code does not limit the number of requests for extension that can be
requested or approved.
!t appears the requested extension meets the requirements of KMC 94.20.150(1}{2}.
Recommend the Commission grant the extension to April 91, 2007.

General Information:
This is an existing commercial building that currently houses Hali's fish and Chips. The
owner is planning to remodel the structure including a complete remodel of the interior,
adding a new roof, siding and storefront. The proposed future use is for professional
offices. Professional offices are a permitted use in the General Commercial zone. The
remodel does not include an addition to the structure but is a change of use so the
landscape/site plan is required.
Because this is a remodel to an existing structure on a developed site, limited
landscaping is planned.
KMC 14.25 specifies the regulations for landscape/site plans within the City of Kenai.
Section 14.25.030 of that chapter details LandscapinglSite Plan submittal requirements.

The front (northern) parcel line abuts the Kenai Spur Highway right-of-
way. The lot is paved to the lot line.
Interior Landscaping -involves areas exclusive of the perimeter and
parking lot areas.

spaces to meet the parking requirements.

RECOMMENDATIONS
The pEan as submitted generally meets the intent of the ordinance. The plan is approved
with the foNowing requirements:
'f . Ground cover - AIE exposed soil must be planted so there will be no exposed
soil within three years. Owner may choose whether to plant with trees,
shrubs, or fawn.
2. Sign shown on the site pEan must be located so as not to obstruct traffic or
block visibility. A sign permit must be applied for and received prior to placing
sign on site.
3. Snow storage must be located on the lot and cannot be placed on required
parking spaces or the snow must be removed from the site. No snow may be
stored in such a manner that would block visibility for ingress and egress to
the lot.
4. The structure for the dumpster must be constructed of wood or concrete.
City administration may approve other ma#erials prior to construction.
5. If construction of the project has not started within one year of the approval of
the landscapinglsite plan, the approval shall lapse unless extended for good
cause.

WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan
provides for orderly and safe development within the City commensurate with protecting
the health, safety, and welfare of its citizens, and provides adequate and convenient open
spaces, light and air in order to avoid congestion of commercial and industrial areas; and,
WHEREAS, the plan appears to provide for landscaping and/or the retention of natural
vegetation in conjunction with commercial and industrial development within the City;
and,
WHEREAS, the purpose of landscaping is to visually enhance the City's appearance and
reduce erosion and storm runoff, and the plan appears to meet this criteria.
NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING
ADMINISTRATION OF THE CITY OF KENAI THAT THE LANDSCAPING/SITE
PLAN IS APPROVED WITH THE REQUIREMENTS NOTED ON PAGE 2.

Additional Requirements:
i . Ground cover -All exposed soil must be planted so there will be no exposed
soil within three years. Owner may choose whether to plant with trees, shrubs,
or lawn.
2. Sign shown on the site plan must be located so as not to obstruct traffic or
block visibility. A sign permit must be applied far and received prior to
placing sign on site.
3. Snow storage must be located on the lat and cannot be placed on required
parking spaces or the snow must be removed from the site. No snow may be
stored in such a manner that would block visibility for ingress and egress to
the lot.
4. The structure for the dumpster must be constructed of woad ox concrete. City
administration may approve other materials prior to construction.
5, if construction of the project has not started within one year of the approval of
the landscaping/site plan, the approval shall lapse unless extended for good
cause.
