Kenai Municipal Code 14.20.150 (i)(1) states, "An approved conditional use permit lapses twelve (12) months after approval if no building permit is procured or if the allowed use is not initiated." The code does allow the Commission to grant time extensions not to exceed six (6) months upon a find'mg that the circumstances have not changed sufficiently to warrant reconsideration of the approval of the permit (KMC 14.20.9 50 (i){2)). The request far extension must be submitted prior to the expiration of the permit. A public hearing is not required. Katherine Fleck has submitted a request, in writing, to extend the permit for six {6} months. The original plans for the development have not changed. Ms. Fleck notes in her letter the probability that she will need to request another extension in six (6) months. The code does not limit the number of requests for extension that can be requested or approved. !t appears the requested extension meets the requirements of KMC 94.20.150(1}{2}.
