After reviewing the information on the application and discussion with some of the other property owners in the area I feel there are a number of concerns in regards to this project that I feel need to be addressed. As we all know this a 37 acre gravel pit that has been completely stripped of sand and gravel from the tree line and weld below ground watex level. For many years the ground water was pumped from the pit to Beaver Creek running into the Kenai River via a small stream an the southeast corner of the property bordering Lat 2 Beaver Creek Estates, so the gravel could be mined. All the loom (Top Sail) was replaced around the outside of the pit to create the lake, so what we have here is a 20 + acre hole fill with ground water suzxounded by leftover tap soil. I have real concerns about water run off from the housing development as well as fertilizer from the Golf Couxse activities any other contaminates seeping into the ground water. I also question the suitability of the property for building homes of any kind due to the nature of the soils. This Project does not represent the intent of the Rural Residential. classification in my opinion. This is mare like a high density Seasonal Recreational Development, Twenty Five dwellings on approximately 10 acres. There are a number of other issues, particularly with the allowable land use activities such as allowing other conditional use permits within this development. This axes is already saturated with high traffic recreational uses particularly on the Angler side and to a certain extent, South Ames Road. At this time Ames has not been paved and is a constant struggle to keep maintained. The site Plan leaves a lot of unanswered questions. + Minimum Maximum size of structures. • Number of outbuildings. • Recreational vehicle storage. • Recreational uses such as Jet Ski's Motor Boats and Float Planes. The way the application reads, you can build anything from a shack to a multiplex and situate it any way you like. At the very Ieast I would like the city to consider requiring baseline water quality samples be taken from the pond as well as the drainage cxeek that runs into Beaver Creek to monitor the run off from the .Golf Coarse, and not allow any further Conditional Use Permits to be granted within the Development. I have contacted the ADEC, ADFG, Kenai River Center as well as the Department of Natural Resources and asked them to review this Permit Application. I realize the city is excited about this project, but I urge the city to take it's time and consider the facts. This is not a 37 acre piece of raw property, this is a gravel pit that has served its purpose and should be re landscaped, seeded and donated back to the community. Seems like the design phase needs more definition before nppraval should be considered. A major concern for us is whether reads will be paved, as we have an existing dust control problem and are working to pave S. In addition to the issues already stated, we are extremely concerned about water contamination and the drainage from the gravel pit. Fertilizer for the golf course and lawns as well as normal run off and 25-35 septic systems on 10 acres around a 25 acre spent gravel pit is a breeding ground for contamination. The water from the gravel pit drains across the south end of our property 365 days a year and dumps into Beaver Creek / Kenai River. we think 35 units on 10 acres is not low density and will cause water quality issues in the gravel pit as well as the drainage that runs across our property. The Fosters orginally approached the home owners on South Ames with a plan for a gated Senior housing developement with a maximum of 18 homes (made up of 3 triplexes) and a golf course. Now the plan. has double in size and may put the surface water that feeds into the Kenai River as well as our own ground water/ drinking water at risk. We realize that the City is excited about this project. However, based on the fact that the number of planned units has doubled in size over the course of a few months we feel that all of the information has not been presented to the city and without defined plans it could easily turn into a seasonal high impact developement such as an RV park or guide service. Please at the very minimum consider getting defined developement plans before signing the rezoning. Ron and I will not be able to atL-end the meeting. This cost could be absorbed by the home owners association. • All dwellings must be a minimum of 1500 square feet in size with permanent foundations built to City code. • Any multiplex units be limited to two units. • All access entry and exits be clearly defined on permit. • No further conditional use permits be issued within Planned Unit Development. • A fence be erected a minimum of eight feet in height before any building can take place on lots #4,5,6,7,8,9 bordering South Ames Road, as most trees will have to come down to accommodate the road and any structures built leaving no buffer between Ames and the PDU. Lot #4 and #5 don' have any trees at all. ® Provide a more clearly defined drainage plan, • No mobile homes or temporary living structures. • Homeowner's association criteria made public. • Any variance's setbacks applied for on lots # 4,5,6,7,8,9 must be made public to property owners within 300 feet. • Terminate the gravel pit conditional use permit and not allow for any mining of raw materials for sale. I personally dan't think this property is suitable for this level of development with the sails and water table issues. I alsn ques#ion the wisdom of allowing the development of to#s #4,5,6,7,8,9 with virtually no buffer between them and the high value real estate bordering Beaver Creek. In xegards to the email from Rusty Huff: In the opening sentence of Mr. Huffs email he states that "as we all know a 37 acre pit has been corrzpletely stripped of sand and gravel." Actually, 5 acres of this project was just purchased 2 years ago and has never been involved in any gravel operation. To correct ane of the other misrepresentations," for many years ground water has been pumped from this pit ". The ground water was pumped a few times many years ago. To address a couple of other slight discrepancies, The size of the lake is 15 acres, And as for this project not representing the intent of the rural residential classification, if twa+ bedroom, two bath, double car garage, ane level homes for 55 or older does not meet residential classification, Idon't know what does. Five of these lots are situated on the recently purchased piece of property. To address same of the other concerns of Mr. Huffs letter in regards to min/ max. size, number of outbuildings, recreational.vehicle storage, recreational use such as jet skis, motor boats and float planes, although we are not going to allow motorized vehicles of any kind on the lake, these questions and others , will be addressed in our Declaration, which, per the city, is to be provided to them before any sales will comumence. Next I would like to address the issue of the drainage ditch which runs down the side of the road all the way from Beaver Loop Rd. to Beaver Creels. This drainage ditch right of way, maintained by the city of Kenai, has been in place for many years and works just fine. Our property has a drainage ditch that connects to this system, which, except in the spring, or rainy season, is dry. Mr. Huff points out that the homes along Ames Rd. are a high value tax base for the city of Kenai. I would like to point out that the homes in this project, if we're allowed to proceed as planned, will be an even higher value tax base for the city. We would also like to address the letter from M.J. Loveland and Ron Rogalsky. Again, I would like to correct some of the figures used in the beginning of this letter. The number of units would be 25 not 35 and the size of the lake is 15 acres. The total area of the property is 37 acres, so our density would be almost 1.5 acres per unit. You wouldn't divide the 25 units into i 0 acres, as MJ and Ron do in their letter. The whole point of a PUD is to take the density that would be permissible in an area and concentrate it away from land features where development would be either impossible ar undesirable. In regards to the claim that the water from our gravel pit drains across their~property .365 days a year, that is simply not a fact. The fact is, water runs out of our lake in the springtime of the year or during very wet seasons only; this year the ditch was dry most of the year. As I discuss below, this proposed development, if approved, would have very significant impacts on residents along Angler Drive, Beaver loop Road and South Ames Road. Perhaps more importantly, it would also have direct and indirect negative impacts on water quality on the Kenai River. Many residents and Kenai River users were shocked by the designation of the Kenai River as an impaired water body by the Environmental Protection Agency. The~City of Kenai has very publicly gone on record with a willingness to pursue strong regulation of in-river users to help resolve water quality problems on the Kenai. T would like to point out that it is inconsistent to be shocked and surprised by the impaired designation, and publicly state a desire to address the problems, while at the same time supporting actions such as the proposed development that will result directly in reduced water quality on the Kenai River. I apologize for not being able to attend your hearing in person, but hope that you will consider my comments, and comments from other residents of the area, in making your decision on this requested conditional use permit. I have presented my comments below under several different topic headings. DeSCription of the project It is impossible to determine what this project is (or will be) from reviewing the application and the review by the City of Kenai staff report. What the project is not is what it says it is, "a Planned Unit Residential Development for 25 units to include a nine-hole private golf course". I base that statement on the basic illogical of the statements and claims made in the application. The platting map submitted to the Kenai Peninsula Borough describes the property area as 35.096 acres. The most prominent feature of this property is a large lake that was created when gravel extraction operations exposed the water table on this hydrologically-charged property. As a result, any contaminants that enter the lake will directly enter the groundwater, used by surrounding residents for their drinking water. A golf course, presumably with grass growing #o the edge of the lake, would result in the use of fertilizer and/or pesticides entering the groundwater aquifer. This is a hydrologically- charged area. The level of the lake is the level of the groundwater, and there are many areas of groundwater seepage along the southwest part of the property. Tn order to minimize contamination of the lake water quality and groundwater, a specific grading scheme to direct runoff away from the lake would be required. The Kenai peninsula Borough has a minimum lot size of 20,000 square feet for anon-site septic system. This property is composed of disturbed sails (from gravel extraction) and is hydrologically charged {as evidenced by the existence of the lake, and the wetlands and runoff from the property). The very small lot sizes and dense development of the proposal will very likely result in contaminated groundwater and runoff water from inadequate septic systems. If the City of Kenai and the property developer wish to have such a high density use, the development should require either connection to City of Kenai sewer system, or an approved single area wastewater processing area for all of the lots on the property. 2) contaminated runoff . oing into the Kenai River -Street and residential water runoff will enter the Kenai River directly, through two means. There is an intermittent runoff stream from the lake that flows a short distance directly into the Kenai River. NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI RECOMMENDS THE COUNCIL OF THE CITY OF KENAI, ALASKA AMEND KMC 14.20.200 by 1) adding subsection (a)(6) incorporating the existing requirement that accessory structures over 120-square feet require a building permit and 2) adding subsection {b) as follows. 1. (6} Accessory structures over 120-square feet require a building permit as set forth in the building code incorporated by reference in KMC 4.05. 2. (b) Storage or use of connex-type structures requiring a building permit in the Central Commercial and residential zones is restricted as follows: (1) Under this section "residential zone" means one of the following zones: Rural Residential Zones, Suburban Residential Zones, Urban Residential Zone, or Townsite Historic Zone. (2} Use or storage of connex-type structures on lots under 20,000 square feet is limited to: {a) One single story connex-type structure; (b) Shall not be larger than 160 square feet; (c} Shall only be allowed in the rear yard (as defined in KMC 14.20.320); {d) Sha11 comply with the development requirements in KMC 14.24.010-030 and KMC 14.20. i 90-200; (e} Shall have all wheeled assemblies removed, be placed on non-rot susceptible blocking or foundation, be roofed and sided or painted to match the primary building on the lot; (f) Shall be roofed and sided or painted within one year of the issuance of a building permit. The develop is planned for an area containing 35.37 acres. This area is large enough to provide low_density development for the 25-units while providing sufficient open space. The residential use will not create heavy traffic. The golf course will be a private course for the residents of the development and will not generate heavy traffic. 2. The value of the adjoining property and neighborhood will not be significantly impaired. The value of the adjoining property and neighborhood should not be impaired; instead, the reclamation of the gravel pit should have a positive effect an these properties. 3. The proposed use is in harmony with the Comprehensive Plan. The Rural Residential land use classification is defined as: "The Rural Residential district includes areas that, due to location or site conditions, are best suited for large-lot single family residential development. Homes in this district typically rely on individual on-site water supply and wastewater disposal systems. " The proposed development appears to be in harmony with the Comprehensive Plan. 4. Public services and facilities are adequate to serve the proposed use. The development will be accessed off Angler Drive, Beaver Loop Road, and Ames Road These are developed roads maintained by the City of Kenai and the State of Alaska. Individual wells and septic systems will service each unit and will meet State of Alaska, Department of Environmental Conservation requirements for on- site water and septic systems. The roads within the development will be private and will be maintained by the homeowner's association. The roads will be built to meet fire and police standards. Based on this information, it appears there are adequate public services and facilities to serve the development. 5. The proposed use will not be harmful to the public safety, health or welfare. This is a residential development; the use will not be harmful to the public safety, health, or welfare. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. There do not appear to be any special conditions that should be required since this is a residential development in a residential zone. 0762 Comments.doc Page 3 Chapter 14.20.170 outlines the criteria for Planned Unit Residential Developments. Section "a" is the same as the criteria required in Chapter 14.20.150. Section "b" sets standards for the development. They are: The proposed development shall meet the applicable conditions specified in KMC 14.20.150. This section is reviewed above. 2, A detailed development plan shall be submitted to the Commission including a site plan drawn to scale. The site plan shall include, but not be limited to, the topography and drainage of the proposed site, the location of alI existing and proposed structures, designated areas of common open space, internal and external cixculation patterns, and location of the required parking spaces. A general floor plan of the principal buildings, together with any requested information, shall also be submitted to the Commission. A development schedule shall also be submitted for the purpose of coordinating the development and open space components of the Planned Unit Residential Development. The applicants have provided a description of the proposed development, a site plan showing the planned development sites, open space (common elements), and access roads. In the description of the development, Ms. Foster explains that they don't have floor plans or schematics as the development may sell units allowing each purchaser to pick their own plans. The parcel contains 35.37 acres; however, the condominium plat shows individual lots. These lots range in size from 10, b10 square feet to 35,204 square feet. The minimum lot size in the Rural Residential zone is 20, 000 square feet; however, the PUD allows for d units per acre or one unit per 7, 260 square feet. The drawing shows minimum separation distances for the wells and septic systems. The systems will be installed by a certified installer and installed to meet state requirements for on-site systems. The PUD does not show required parking spaces. Each unit will be required to meet the parking requirements of KMC 14.20.250. Single family dwellings will require two parking spaces; multi family dwellings also require two parking spaces per unit. This is a phased development. Ms. Foster has described those phases in her letter dated November 2d'h. 3. The minimum parcel size allowed fax a Planned Unit Residential Development shall be 2.5 acres, inclusive of any dedicated right-of--way or public use easement which may exist within the boundaxies of the site. This site is 35.37 acres. 4. The building coverage within the Planned Unit Residential Development shall not exceed thirty percent (3 0%) of the site area in the RR and RS zones or forty percent (40%} of the site if located in the RU zone. An email from Cliff Baker of Integrity Surveys explains that the community golf course and access ways will cover approximately 24.8 acres and approximately 10.3 acres will be for the private units. Common areas will encompass approximately 70 percent of the development and the area set aside for private units will encompass the other 30 percent. The building coverage will be much less than the allowed 30 percent (30%). 7. The following design standards shall govern the Planned Unit Residential Development; a. The development requirements of the specific zoning district, except as otherwise allowed, shall apply to all portions of the development. This means that each until will be required to meet setback requirements for the Rural Residential zone: Front setback of 25 feet, rear of 20 feet, and side of I S feet. The sites shown on the condominium plat will be used to determine these setbacks and any unit unable to meet the setback requirements must apply for and receive a variance prior to construction. b. All areas not devoted to building or associated parking areas shall be left in its natural state, appropriately landscaped, utilized for an active or passive recreation area, or developed for a purpose specified in a submitted site development plan. This is reclamation of a gravel pit that includes a pond, and a golf course. The area around the units will be landscaped according to the homeowner's association criteria. c. A minimum of thirty percent (30%) of the site shall be reserved as usable open space. Any portion of this open space may be reserved in common for the benefit of the residents within the Planned Unit Residential Development. As noted, the portion of this development reserved for common space is approximately seventy percent (70%) exceeding this requirement. d. Residential and nonresidential uses within the Planned Unit Residential Development shall be separated by a buffer strip, landscaped area, fence, or other manner deemed appropriate by the Commission. The developer or subdivider of any Planned Unit Residential Development including common open area, property, or amenities, shall have evidence that compliance with Horizontal Property Regimes Act, AS 3d.07 has been made prior to the sale of any townhouse dwelling units. All development is to be privately maintained. On-site water supplies and wastewater disposal must meet State of Alaska, Department of Environmental Conservation requirements. Building Official: No building codes issues at this stage. RECOMMENDATIONS This is a planned unit residential development, which will reclaim a gravel pit. The site contains 35.37 acres. The development will contain 20 single-family dwellings with a possibility of adding an additional Ssingle-family dwellings units or 5 duplex-type dwellings. This is planned as a gated community with a private golf course. At this time, the plan is to develop the plan in three phases. The developer would like to begin development of phase one in the spring of 2008. Each dwelling unit will have an individual well and septic system and will meet State of Alaska requirements for on-site water and septic systems. The roads within the development will be privately developed and maintained and will be built to meet emergency service vehicle requirements. The prospect of a full reclamation of a gravel pit to this extent is very exciting for the City of Kenai. We are thinking of putting up a spec house on our own, we'll have to see come spring. We may just sell the units to individuals wl them picking their own plans. The units (building lots} range in size from 10,610 sq. ft to 3 5,204 sq. ft. Each unit will have its own well and septic. Cliff should have sent you a topography map also showing the location of the well radius on each unit, internal and external circulation patterns and designated common areas. Each unit will have an equal, undivided interest in the common elements, which will be the lake, golf course and roads. These will be maintained by the Home-Owners Association. We, as the developers, will carry the majority of the costs of these elements, until such time as enough units are sold for the HOA to take aver that cost. We are planning on Phase I to consist of 10 or 11 units. Phase II will have fi units and Phase III will have $ units. We are hoping to start Phase 1 this spring. It would be impossible to designate exact locations of structures and driveways at this time, as it will depend on what plans buyers choose and how they locate them on each unit. The property owners are in the process of developing the golf course at this time. The access road between Units 1, 18-24 exists and will be upgraded. The access road in front of units 1-3 will be part of the 1st phase. Maintenance will be performed by the homeowners association. We have provided turn-a-rounds that will meet CES codes. Each Unit is designed to have on site individual wells & septics. I have shown a layout with we11 radius' that will provide all units with adequate waste disposal area. With the community golf course and access ways approximately 24.8 acres will be common interest with 10.3 acres for private units. This approx. 31% for common area. The attached layout shows spot elevations and contours. If drainage arrows with grades are required, please let me know, Basically the drainage is collected in the ponds and will eventually drain out of the southeast corner when ever there is a high rain fall. City Engineer:, Front setbacks on corner tots can severely reduce buildable area, often causing encroachments. Building Official: Approving this encroachment will not violate building code requirements for separation distance. RECOMMENDATIONS The applicants as-built identified the encroachments during the final review of the building permit. Administration determined the front of the house is off Inlet Woods Drive even though the driveway is off of Portside Drive.
