CITY OF KENAI
ORDINANCE NO. 2184-2006
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
PORTIONS OF KMC 1.56 (KENAI MUNICIPAL LIBRARY DEPARTMENT) AND KMC 1.57
(LIBRARY COMMISSION) REGARDING LENDING FOLICIES, AND REPLACING THE
TERM "LIBRARIAN" WITH `LIBRt~RY DIRECTOR."
WHEREAS, KMC 1.56 and KMC 1.57 contains the city ordinances relating to the
Kenai Coinmunity Library and the Kenai Library Commission; and,
WHEREAS, the Kenai Library Commission has recommended amendments to KMC
1.56 regarding lendin~ policies and changing the term "Librarian" to "Library
Director"; and,
WHEREAS, the Kenai Library Commission is charged under KMC 1.56.010(c) to make
reconunendauons to u~e Kenai City Council regarding Iibrary matfers: and,
WHEREAS, it is in the best interest of the City of Kenai to amend the Kenai Municipal
Code as shown in Attachment A.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that KMC 1.56 and KMC 1.57 are amended as shown in Attachment A.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, EILASKA, this siacth day of
September, 2006.

Chapter 1.56
K~NAI MUNICIPAL LIBRARY DEPARTM~NT
1.56.010 Creation.
There shall be a Municipal Library DepartmenC, Che head of which shall be the Librarian,
appointed by the City Manager tor an indefinite term. The [LIBRARIAN] Library Director shail
be an officer of the Cify and have supervision and control of the Kenai Community Library.
1.56.020 Authority for adoption of rules, regulations, and fines.
The [LIBRARIAN] Library Director shall establish rules and regulations far conduct on the
property of, and use of, the Kenai Community Library and iibrary materials and a fine or penalty
charge schedulc for overdue, damaged, or failure to return loaned libraiy pro}~erty, which rules
and regulations shall be effective after approval by City Council and after being posted in a
location within the library readily visible by library patrons.
1.56.025 Library cards.
No maCerials will be loaned fro~n the library except to parties having a valid library
identification eard which is not subject to any unpaid fines or penalties in excess of $10. Such
librazy idenCification c~ud will be issued to any resident of tl~e area maldng application therefor
and upon a form prepared by the Librarian and conCaining an agreement to be responsible for all
maYerials boirowed thereon and to pay any fines, charges, or penalries imposed by misuse of
Iibrary property. However, no such card will be issued to a minar (under the age of 18) unless the
applicarion for said card is also signed by a parent of such child or one standing in place of the
parenC who is willing to assume responsibility for the child and for any misuse of library
~~ ~ privileges.
1.56.030 Sleeping and resting prohibited.
No one shall sleep within the library or outsidc the library upon library property at any time
nor shall anyone lie in a reclined position witl~in or outside the library or library grounds. To lie
in a reclined position means to posifion one's body parallel to fhe f7oor or ground whether one is
on the floor, ground, a table, bench, chairs, couch, eounter, shelves, card cases, or any other item
of furniture.
L56.040 Refusing to return loaned material.
No person, firm, or corporation sha11 knowingly refuse to return any reading material,
including books, periodicals, newspapers, maps, adases, or any non-reading material including
cassetYes, record players, screens, and projectors Ioaned to said person, firm, or corporation
witl~in thirty (30) days after said reading or non-reading materiai becomes overdue. (Ord. 536)
1.56.045 Lending policy where loaned material not returned.
L,ending privileges far any library materials will be suspended on any library card on which
materiais have been loaned and have noC been returned when due or on which any fines, chaz-ges,
or penalties in excess of $10 have been assessed which are in arrears. [WHERE PRIVILEGE OF
ANY MEMBER OF A FAMILY GROUP 4VH0 IS A HOLDER OF A LIBRARY CARD HAS
BEEN SUSP~ND~D UNDER TERMS OF THIS SECTION, THE LIBRARIAN IS
AUTHORIZED, BY GIVING PRIOR WRIT"I'EN NOTICE OF SUSPENSION TO A

PARENTAL FIGURE AT THE ADDRESS ON THE CARD, TO SUSPEND THE USE OF
ALL OTHER LIBRARY CARDS OF THE FAVIiLY GROUP UNTIL THE OVERDUE
MATERIALS HAVE B~EN RETUI2NED OR THE FIlVES, CHARGES, OR PENALTIES ON
THE SUSPENDED CARD HAVE BEEN PUI.LY PAID.)
L56.050 Penalty.
In addition to any fine levied or other penalty imposed ~ursuanC to this ord~inance or
regnlations imposed thereunder, any person, firm, or corporation who shall violate any provision
of Chis chapter including any rules and regulations as herein set forth, or fail to comply therewith
upon convrction tl~ereof shali be punished by a fine as provided for violations in KMC
13.05.010.
Chapter 1.57
LIBRARY COMMISSION
1.57.010 Duties and powers.
The Commission shall be required to do the following:
(a) Develop, adopt, alter, or revise subject to approval by the Ciry Council, a master plan for Che
~ physical development of library facilities for the City;
~ (b) Submit annually to the City Manager and Council a list of recommended capital and other
improvements in regards to Che library;
(c) Make recommendaCions regarding any matter related to library serviee;
(d) Serve as the liaison between the public and the City Council in regards to library service;
(e) Work closely with the Friends of Che Kenai Communify Library [BOARD] for the betCeiment
of the Kenai Community Library;
(f) Shall act in an advisory capacity in the selection of the [C1TY LIBRARIAN] Librarv
Director.
1.57.020 Library regulations.
The Library Regulations shall be as listed Under the regulations section in the Kenai Code,
Supplement #18, adopted on SeptemUer 20, 1982, and all futm~e updates.
