HomeMy WebLinkAboutOrdinance No. 2193-2006Suggested Uy: Administration CY'CY OF KENAI ORDYNANCE NO. 2193-2006 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING THE CODE VIOLATION FINE SCHEDULE IN KMC 13.10.015 TO INCLUD~ A STANDARD FINE OF $25.00 FOR FAILURE TO OBTAIN A DOG LICENS~ IN VIOLATION OF KMC 3.20.010. WHEREAS, KMC 3.20A10 requires a person, other than a licensed kennel operator, owning a dog over three months of age to obtain an annual City of Kenai dog license; and, WHEREAS, under KMC 3.05.060 and KMC 13.05.010 Lhe maximum penalty for violating that section of the municipal code is $500.00; and, WHEI2~AS, a standard fine in the amount of $25.00 should be set for that offense; and, WHEREAS, it is in the best interest of the City of Kenai to include a violation of KMC 3.20.010 in the code violation fine schedule with the standard fine set at $25.00. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA that KMC 13.10.015 is amended as shown on Attachment A. Graves, City Attorney DA'TE: October 12, 2006 RE: Do~ License Violation Fines The city code (KMC 3.20.010) requires dog owners, oflier than licensed kennel operators, to get an annual dog license for dogs over fl~ee months of age. The cost is $2.00 for spayed or neutered and $10.00 for non-s}~ayed or neutered. The new Cluef Animal Control Officer, Patricia ~~ Springer, is trying to increase compliance with d1e Iicensing requiremenC. `I'he pen~lty for faihire to license a dog is currently a fine up to $500.00. Sec KMC~ 3.05.060 and KMC 13.05.010. Ms. Springer would like set a standard fine of $25.00 for failure to license. The $25.00 fine would be added to the city's fine schedule vi KMC 1310.015. The administrative process for minor violatiions is easier for both the city and person cit~d if the violation has a standas•d fine adopted in the city fine schedule. Ms. Springer does not intend to aetively patrol far unlicensed animals. Instead, if she has a contact with an unlicensed dog for other reasons, she would cite the owner for failure to licensc. At least initialiy, the intent is to make Yhem "fix iP' tickets. If the owner can2e in aud got a license withns limited cime frame, the ticket would be dismissed. The idea is to increase compliance wiCh the lieensing requirement. 1'lease let me know if you have any questions.
