HomeMy WebLinkAboutResolution No. 2009-39the aPyef KENAI. im ALASKA CITY OF KENAI RESOLUTION NO. 2009 -39 WHEREAS, there were no contacts made by interested parties; and, Suggested by: Administration A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A FUEL DISPENSING CONCESSION AGREEMENT FOR THE KENAI MUNICIPAL DOCK. WHEREAS, Jackson Enterprises, Inc. approached the City and expressed a desire to operate a fuel concession at the Kenai Municipal Dock; and, WHEREAS, on June 22 -25, 2009 the City of Kenai published a public notice requesting that parties interested in purchasing bulk fuel from the city and /or operating a fuel dispensing concession at the City of Kenai Municipal Dock contact the City on or before June 25, 2009; and, WHEREAS, as a part of the concession agreement, Jackson Enterprises, Inc. will purchase the fuel presently in the tanks at the City Dock for the price Jackson Enterprises sells bulk fuel, Jackson Enterprises will dispense fuel using the City's equipment, and Jackson Enterprises, Inc. will pay the City a fuel flowage fee of 0.05 per gallon for fuel sold at the dock; and. WHEREAS, this will decrease the number of city employees working at the City Dock. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, the City Manager is authorized to enter into a Fuel Dispensing Concession Agreement with Jackson Enterprises, Inc. for the Kenai Municipal Dock for the period July 2, 2009 through September 30, 2009. Jackson Enterprises, Inc. approached the City with a proposal to dispense fuel at the City Dock instead of the City. I. Jackson Enterprises, Inc. would purchase any fuel presently in the tanks for the present wholesale price from Jackson Fuel, Inc. 2. Jackson Enterprises, Inc. would provide a certificate of insurance naming the City as an additional insured in the limits required by the City. 3. Jackson Enterprises, Inc. would pay the City a fuel flowage fee of 0.05 per gallon for each gallon of fuel sold. 4. Jackson Enterprises, Inc. would provide personnel to operate the City's fuel dispensing equipment and make any incidental repairs required for its operation. The administration published a Public Notice in the Peninsula Clarion requesting that any individuals or companies interested in the purchase of bulk diesel and /or gas, and /or a concession agreement to dispense fuel at the City Dock contact the City Manager on or before June 25, 2009. There were no contacts made by any interested parties. 1 11 1' 1992 Entering into a concessionaire agreement will allow us to reduce staffing at the City Dock. It will also eliminate the risk of the City buying fuel at prices that are higher than what the fuel can be sold for during the same or subsequent season (as is the case this year). Publish: 6/23/09 6/25/09 PUBLIC NOTICE KE NA ALASKA The City of Kenai is considering the sale of bulk diesel (5,675 gallons) and gasoline (550 gallons) fuel at the Kenai City Dock, and awarding a concession agreement to a contractor to dispense fuel at the Kenai City Dock. If there are individuals and /or firms interested in the purchase of the bulk fuel and /or operating a fuel dispensing concession at the Kenai Municipal Dock, contact Christine Cunningham at (907)283 -8223, on or before June 25, 2009.
