WHEREAS, the City of Kenai has received a petition to form~special assessment district in the above-mentioned paving project; and, WHEREAS, the Council must set a date of public hearin,~ on the proposed assessment district. ,~ NOW, THEREFORE, BE IT RESOLVED BY THE~NCIL OF THE CITY OF KENAI, ALASKA, that Yhe date of the public hearing on t proposed Angler Drive Paving Special Assessment District be set for April 5, 2 6. Freas, City CI~~~~ DATE: February 10, 2006 RE: PROPOSED ANGLER DRIVE PAVING DISTRICT The processing of a Local Assessment District (LID) begins with a petition being submitted with signatures of at least 50% of the property owners to be affected by the improvement. Clerk prepares and includes Set by Resolution No. 2006-05. resolution for continuation of the i project to council. ~ ; Memorandum of Explanation Resolution No. 2006-05 Page 2 Council is now at the point where it considers Resolution No. 2006-05, setting a public hearing within 60 days. If passed, within the 60-day period Administration would hold a cost allocation meeting with the property owners, discussing rate of assessment, funding sources, etc.; the public hearing notices would be sent to the property owners; and, a notice would be advertised in the newspaper for four consecutive weeks. It is important for council to know the following: • Currently, there is no funding avaiiable for this project. • The newspaper advertisement (published four consecutive weeks prior to the hearing) will cost appro~mately $800. • A lot of in-house preparation work will need to be done within the 60 days and will affect the property owners. The preparation work could be all for naught if the process is continued and no funding is identified. • Currently, there is no provision in the code to hold the petition in an active mode until funding is identified. If Resolution No. 2006-OS fails, the project/process stops (property owners would be informed of the council action). A new petition would be required to begin again. Reeommendation: Because no funding is available at this time, it is Administration's recommendation Council not move forward with this project. clf
