HomeMy WebLinkAboutResolution No. 2006-37Suggested by: City Council CITY OF KENAI RESOLUTION NO. 2006-3'7 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, SE'I`TING THE PUBLIC HEARING DATE ON THE PROPOSED SHAMROCK CIRCLE PAVING DISTRICT. WHEREAS, the City of Kenai has received a petition to form a special assessment district in the above-mentioned paving project; and, WHEREAS, the Council must set a date of public hearing on the proposed assessment district. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the date of the public hearing on the proposed Shamrock Circle Paving Special Assessment District be set for August 16, 2006. Froin: Rick Kocb, City Manager '(Vq Y Date: Ju»e 30, 2006 Subject: Shamrock Circle LID The purpose of this correspondence is to discuss the above refereneed LID. At this time the FY 2007 budget does not contain funding for this project. There are severai sources of poYentiai funding. If the LID is ultvnately approved by the council in the estiinated amount of $ 89,500, there is contained in the SYate of Alaska FY 2007 budget two grants that could be used dependent upon specific grant language. There is a grant from the Department of Commerce, Community & Economic Development (DCCED) in the amount of $ 322,000 for road, water, & sewer improvements, and a federal earmark through the Department of Transportation & Public Facilities (DOT/PF) in the amount of ~ 850,000 for road improvements. The DCCED grants are historieally administered in a manner very conducive to using those funds for an LID, allowing the grant recipient to manage the projects iii accordanee with grant requirements. The federal earmark administered Chrough ADOT/PF will have its challenges. Central Region ADOT/PF has historically resisted efforts to "pass through" the funding to the recipients, and instead has demanded to manage the projects themselves, burdening the projects with administrative/engineering costs averaging 40% of the available funding. We will be meetiilg with ADOT/PF later in Ju1y to discuss the maru2er in which the $ 850,000 earmark will be administered. The City's posifion is tl~rough a inemorandum of agreement (MOA) we be allowed to manage the desig~l and construction of projects funded by this earmark, in accordance with the condiTions of the MOA, without a ~ signifieanC administrative load being placed on the project(s) by ADOT/PF. Based on these challenges I would not recoinmend use of the federal earmark for this LID. Page 2 Memo to Council June 30, 2006 fi1 regards to tl~is specific LID, I see the o~tions as follows: l. Council does i~ot pass the resolution setting a date for a pubiic hearing, as there is not at present, an identified funding source to support the $ 89,500 project. This effectively dismisses this LID petition. 2. Council sets a public hearing date far August 16, 2006, and at the regularly scheduled council meeting of July 19, 2006 discusses use of the $ 322,000 grant from DCCED, and iYs use to support this project. If the council decides to not fund the project it will still be necessaty to hold the scheduled public hearing as code required advertisin~ would have already begun. Administration recommends the councii set a public hearing for the LID. Advertising costs are estimated at $ 400, and it allows the process to move forward concurrent with council's discussion of DCCED grant supported capital improvement priorities.
