HomeMy WebLinkAboutResolution No. 2004-38Suggested by: Administration City of Kenai RF~OLUTION NO. 2004-38 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALAS~, TRANSFERRING $4,500 FROM LEGAL DEPARTMENT PROFESSIONAL SERVICES TO SALARY AND BENEFITS TO HIRE A PART-TIME CODE ENFORCEMENT OFFICER. WHEREAS, there is a need for code enforcement services for the City of Kenai; and WHEREAS, the fiscal year 2004-2005 Legal Department Budget contained $4,500 in the professional services account to contract for code enforcement services; and WHEREAS, it has been determined that it is not practical to contract out for those services; and WHEREAS, transferring the money from professional services to salary and benefits would allow for hiring a temporary, part-time code enforcement officer; and WHEREAS, the code enforcement officer would work as a temporary, part-time employee, working less than 15 hours per week, and would not be eligible for benefits such as holiday pay, annual leave or medical insurance. Graves, City Attorney DATE- June 30, 2004 RE' Code Enforcement Officer When the FY 2004-2005 budget was presented, it was envisioned that the code enforcement position would be contracted out. It does not appear practical at this time to do that. The value of the contract is relatively small. Because of the nature of the position, the person doing it needs insurance coverage; but, because of the size of the contract, it is not economical to purchase that type of liability insurance just for this contract. Making the code enforcement person a temporary part-time position would mean the person would not receive benefits such as holiday pay, medical, or annual leave. We would have to pay for such things as workers compensation and Medicare. Ordinarily, a temporary position is hired only for a period of six months. KMC 23.05.070(0. The temporary status would expire toward the end of the calendar year. That is traditionally a slow time for code enforcement. The administration would then decide whether to request the position be made a regular part- time position. That position also would not receive benefits because it would still be less than 15 hours per week. KMC 23.40.010. If it were decided to keep the position as a temporary one, the temporary employee would be laid off after six months (probably in December). In the spring (when code enforcement picks up again), a temporary code enforcement person would be added. The resolution in the packet transfers money from Professional Services to Salary and Benefits to reflect the change from a contract to a temporary, part-time employee.
