HomeMy WebLinkAboutResolution No. 2008-48Suggested by: Councilor Swarner CIT% OF i{ENAI 1ESOLUTION NO. 200$-48 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ESTABLISHING A POLICY REGARDING DONATION OF MONEY, SERVICES OR EQUIPMENT OF $5,000 OR MORE IN A FISCAL YEAR TO ANON-PROFIT [501(C)(3) ORGANIZATION REQUIRING THAT THE NON-PROFIT PROVIDE TO THE CITY AN IRS 990 TAX FORM AND AN AUDIT OR FINANCIAL STATEMENT THAT IS ACCEPTABLE TO THE CITY FOR REVIEW PRIOR TO DISBURSEMENT OF A DONATION OF FUNDS, SERVICES OR EQUIPMENT. WHEREAS, the City of Kenai has in the past and will in the future donate money, services or equipment valued at $5,000 or more to non-profit (501(c)(3)) entities; and, WHEREAS, the Council should have information available about the non-profit's financial conditional prior to making a decision regarding donation of funds, services or equipment; and, WHEREAS, requiring the non-profit entity to provide an IRS 990 form and an audit or a financial statement that is acceptable to the City will provide needed information to the City Council and allow it to make informed decisions on donations of $5,000 or more; and, WHEREAS, it is in the best interest of the City of Kenai and its citizens to implement such a policy. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that the Council of the City of Kenai adopts a policy that prior to disbursement of a donation of City funds, equipment or services in the amount of $5,000 or more in a fiscal year to anon-profit (i.e. 501(c)(3)) organization, the organization must provide an IRS 990 tax form and an audit or financial statement acceptable to the City of Kenai for review.
