HomeMy WebLinkAboutResolution No. 2007-22Suggested by: City Administration CITY OF KENAI RESOLUTION NO. 2007-22 A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AUTHORIZING THE PURCHASE OF TRACT A, ALASKA STATE LAND SURVEY NO. 2004-25 FROM THE STATE OF ALASKA, FOR MARKET VALUE, FOR A FUTURE WATER WELL SITE. WHEREAS, the City of Kenai wishes to purchase Tract A, Alaska State Land Survey No. 2004-25 from the State of Alaska for a future water well site, as shown on Attachment "A" of this resolution; and, WHEREAS, the State of Alaska has agreed to sell the property to the City of Kenai for a public and charitable use; and, WHEREAS, the consideration agreed to is market value ($8,750) as reported in the Retrospective Summand Appraisal Report produced by Steve MacSwain of MacSwain Associates, and dated August 26, 2004; and, WHEREAS, KMC 22.05.135(a) states the following: The city, by authorization of the city council, expressed in a resolution for such purpose, may lease, purchase or acquire an interest in real property needed for a public use on such terms and conditions as the council shall determine, but no purchase shall be made until a qualified appraiser has appraised the property and given the council an independent opinion as to the full and true value thereof; and WHEREAS, the State requires a $100 patent fee to transfer the deed; and, WHEREAS, the deed of conveyance shall contain a reversionary interest if the land is used for anything other than a well site under AS 38.05.810. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, the Council authorizes the sale of Tract A, Alaska State Land Survey No. 2004-25, for market value, for a future water well site.
