RESOLUTION NO. 2011 -38

A RESOLUTION OF THE COUNCIL OF THE CITY OF' KENAI, ALASKA, SETTING A
DATE FOR HOLDING A PUBLIC HEARING ON THE PROPOSED JAMES STREET
SPECIAL ASSESSMENT DISTRICT.
WHEREAS, the City of Kenai has received a petition to form a special assessment
district to bring James Street road to gravel standard of the City; and,
WHEREAS, pursuant to KMC 16.10.030, the Council must set a date for holding a
public hearing on the proposed Special Assessment District within sixty (60) days from
the date of this resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, the date of the public hearing on the proposed James Street Special
Assessment District is set for June 15, 2011.

RE: PROPOSED JAMES STREET SPECIAL ASSESSMENT DISTRICT
Setting of Public Hearing
A petition was submitted by property owners along James Street requesting the road
be brought to gravel standard of the City. The petition was found to be sufficient; the
petition was forwarded to the City Manager, who provided a report to the City Council
at the April 6, 2011 Council Meeting; and, the City Manager filed a preliminary
assessment roll with me on May 5, 2011.
Kenai Municipal Code directs, upon the filing of the preliminary assessment roll, the
Council, by resolution, must schedule a public hearing within sixty (60) days after the
date of setting the public hearing.
The suggested public hearing date identified in Resolution No. 2011 -38 is June 15,
2011. This date will allow for the required publishing of the public hearing notice in
the newspaper at least once a week for four (4) consecutive weeks and the written
notice to be sent by mail to every record owner of property within the proposed local
improvement district at least fifteen (15) days prior to the public hearing
