RESOLUTION NO. 2011 -39

A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, SETTING A
DATE FOR HOLDING A PUBLIC HEARING ON THE PROPOSED JAMES STREET AND
KIANA LANE SPECIAL ASSESSMENT DISTRICT.
WHEREAS, the City of Kenai has received a petition to form a special assessment
district to improve James Street and Kiana Lane by excavating, filling and backfillin.g
with crushed aggregate base course, asphalt paving, striping, signage and other
related improvements; and,
WHEREAS, pursuant to KMC 16.10.030, the Council must set a date for holding a
public hearing on the proposed Special Assessment District within sixty (60) days from
the date of this resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, the date of the public hearing on the proposed James Street Special
Assessment District is set for June 15, 2011.

PROPOSED JAMES STREET AND KIANA LANE SPECIAL
ASSESSMENT DISTRICT
Setting of Public Hearing -- Resolution No. 2011 -39
Subsequent to the submittal of the James Street Special Assessment District petition,
a second petition was submitted by property owners along James Street and Kiana.
Lane requesting improvements, including excavation, classified fill and backfill,
crushed aggregate base course, asphalt pavement, striping, signage and other related
improvements. The petition was found to be sufficient; the petition was forwarded to
the City Manager, who is providing a report to the City Council with this submission
prepared for the May 18, 2011 Council Meeting; and, the City Manager filed a
preliminary assessment roll with me on May 10, 2011.
Kenai Municipal Code directs, upon the filing of the preliminary assessment roll, the
Council, by resolution, must schedule a public hearing within sixty (60) days after the
date of setting the public hearing.
The suggested public hearing date identified in Resolution No. 2011 -39 is June 15,
2011. This date will allow for the required publishing of the public hearing notice in
the newspaper at least once a week for four (4) consecutive weeks and the written
notice to be sent by mail to every record owner of property within the proposed local
improvement district at least fifteen (1.5) days prior to the public hearing.
