PZ08-06 - A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recommending to the Council that KMC 14.25 Landscaping/Site Plan Regulations be amended requiring approval of plans before clearing any land, requiring buffer separation between commercial and residential uses, extending the completion time to two years and providing that the approval may be revoked with thirty days notice. Kebschull reviewed the staff report included in the packet, noting advance approval of the site plan would be needed if more than 75% of the lot would be cleared. Twait read the rules for public hearing and opened the meeting to public comment. Kellie Kelso, I ].7 Walker Lane -Supported the resolution, noting concern that a wall could be considered a buffer. Richard Steiner, 1 I7 Walker Lane -Spoke in favor of natural buffers, not walls or fences, noting property values would stay higher with natural buffers. There being no further comments, the public hearing was closed. MOTION: Commissioner Bryson MOVED to approve PZO$-05 and Commissioner Romain SECONDED the motion. PZOS-11 - A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska recommending to the Council that KMC 14.20.200 {Accessory Structures) be amended by 1) Adding a section restricting the use or storage of connex-type structures in the central commercial and residential zones and 2) Requiring accessory structures be built to match the primary building on the lot and 3) Providing for terz~.porary use of connex-type structures during construction projects and incorporating the existing requirement that accessory structures aver 120-square feet require a building permit. Kebschull reviewed the staff report included in the packet, noting connex structures and sheds would be covered by the same codes, and the resolution allowed for temporary storage using connexes. Twait opened the meeting to public hearing. There being no comments, the public hearing was closed. MOTION: Commissioner Rornain MOVED to approve PZO8-11 and Commissioner Wisniewski SECONDED the motion. Commissioner comments included: • This is just a recommendation to Council, and comments can be made to Council at that time. The public could still apply for a variance if necessary. Borough Planning -- Bryson reviewed the agenda from the February 25, 2008 Borough Planning Meeting, noting a presentation by the Watershed Forum regarding Water Quality Assessment. 9-a. Administration - Kebschull reported the next meeting (March 12, 2008) would include a public hearing on the rezoning of airport lands; the site plan for Arctic Barnabas Ministries had been received; and there would be a public hearing on amending a conditional use permit within Angler Acres. ITEM 10: PERSONS PRESENT NOT SCHEDULED Pat Porter, 310 Rogers Road -- Thanked the Commission on all their hard work on the connex issue. ITEM 11: INFORMATION ITEMS 11-a. WHEREAS, KMC 14.20.200(a)(2) now allows for accessary structures of not more than one hundred twenty (120} square feet and not more than one story in, height to be in setback areas provided they are not closer than three feet to the adjoining lot; and, WHEREAS, limiting the size of such accessory structures to one hundred twenty (120) square feet is too small for many items to be stored in; and, WHEREAS, increasing the size of such accessory structures would allow for more inside storage without the added expense of another out building, thus reducing outside storage in yards; and WHEREAS, increasing the distance to side setback would insure larger structures do not adversely affect adjacent properties; and, WHEREAS, allowing larger single storage buildings would decrease the need for additional buildings in yards; and WHEREAS, existing setbacks for sheds above one hundred twenty (120 square feet cause a significant loss of usable yard space; and WHEREAS, it is in the best interest of the City of Kenai to amend KMC 14.20.200(a)(2) to increase the size of allowed accessory structures in the setback from one hundred twenty (120) to two hundred (200) square feet and to increase the distance from the adjoining lot to five feet (5~. This application is submitted at the direction of Council who received a request from the Airport Commission. During development of the Airport Supplemental Pian issues with the City`s procedures far leasing airport lands was discussed. One of those issues dealt with zoning and that the majority of airport land that had not been subdivided was zoned Conservation restricting development. The Land Use Table in Chapter 14 of the Kenai Municipal Code was amended to allow FAA authorized uses for properties inside the airport perimeter fence or having access to aircraft movement areas, ramps, taxiways, or parking aprons. This amendment was ashort-term solution for properties abutting those areas noted above. The 2008 Comprehensive Plan also identified issues with the zoning of airport lands and recommended a revision of zoning of airport properties to comply with future expected uses. The proposed rezone encompasses approximately 1166 acres and meets the requirements for an amendment to the official zoning map. RECOMMENDATIONS The City of Kenai is applying to rezone approximately 1166 acres of airport land located within the Airport Reserve. The majority of the property is zoned Conservation. Two parcels are zoned Rural Residential. The present zoning is not conducive to airport land uses. The building must be placed to meet the 50-foot Airport Building Restriction Line. 5. Prior to removing airport security fence or installing new fencing, Mary Bondurant, Airport Manager must be consulted to insure airport security requirements are met. 6. Prior to installing fencing shown in the right-of-way, or any digging in the City's rights-of-ways, the .City of Kenai Public Works Department must be contacted to obtain an excavation permit. 7. Driveway permits must be obtained from the City of Kenai Public Works Department far the access onto Granite Point Street and North Willow Street. 8. The parking !ot must be paved within two (2} years of the Certificate of Occupancy. 9. Snow storage must be located on the lot and cannot be placed on required parking spaces or the snow must be removed from the site. No snow may be stored in such a manner #hat would block visibility for ingress and egress to the lot. 10. The structure for the dumpster must be cons#ructed of wood or concrete. City administration may approve an alterna#ive plan prior to construction. 11. Section KMC 14,25.030 details landscaping/Site Plan submittal requirements. This is the final landscapelsite plan for the planned development for Arctic Barnabas Ministries. A preliminary landscapelsite plan was reviewed and approved in August 2007 to allow for site preparation. The preliminary plan included an aircraft hangar and office building. This plan has expanded to include a cafe. The preliminary plan had two accesses off North Willow Street. The City Engineer asked the developer to consider removing one of these driveways. The revised plan shows one driveway off North Willow Street with a separate entrance off Granite Point Street. The applicant has submitted an updated site plan far the proposed development. The plan shows the proposed building, driveways, drainage, parking, dumps#er, fencing, snow storage, sign, and landscaping. Four types of landscaping are defined in KMC 14.25.040: Perimeter/Buffer landscaping -involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. o This development is on the corner of North Willow Street and Granite 08-12 (Q74$) Comznent.doc Page 2 Paint Street. The landscaping plan includes landscaping along three sides of the lot with the exception of driveways. The rear of the lot is on the taxiway and cannot be landscaped. The landscaping is limited in some areas due to the need to provide far parking. In addition, the area along the Willow Street right-of-way is already landscaped. Landscaping includes lawn areas, shrubs and trees. Landscaping stones are used in and around the shrubs and trees. A concrete patio with a flower garden is planned for the northwest side of the property. An 8-foot security fence will separate the front of this property from the taxiway. The landscaping in the updated plan has not changed from the preliminary plan. • Interior Landscaping -- involves areas exclusive of the perimeter and parking lot areas. o A concrete pa#io with a flower garden is planned far the northwest side of the property. • Parking Lot Landscaping -involves areas adjacent to or within parking lots and access drives. o Areas adjacent to the driveways will be landscaped and the area along the perimeter of the parking lot will be landscaped. The landscaping in the updated plan has not changed from the preliminary plan. • Street-right-of-way Landscaping --. intent to soften the impac# of land uses along rights-of-way but does not obscure land uses from sight. o As noted, this property abuts the Willow Street right-of-way that is already landscaped with lawn. There is additional landscaping planned along edge of the property and the right-of-way. Along Granite Street there is grass planned and landscaping between the lawn area and the parking spaces. n During site preparation work, the right-of-way landscaping was damaged. The City requires all damages to the grass strip along the perimeter of the parcel must be graded and reseeded. o The code requires 10-foot minimum of landscaping along property lines that abut street right-of-ways. The plan does not meet the 10- foot minimum and shows same landscaping on the City right-of-way. Willow Stredt is a 100-foot right-of--way and Granite Point Street is a 60-foot right-of-way, With the City's grass strip and the landscaping shown in the plan, the proposed landscaping appears to meet the intent of the code. n The landscaping in the updated plan has not changed from the preliminary plan. Landscaping plants include Hoopsii Spruce, Spruce, Red Leaf MayDay, Green Leaf MayDay, Ruby Frost Maple, European Mountain Ash, Ash Leaf Spires, Lilac, Potentilla, and Dwarf Mugo Pine. Kenai Municipal Cade 14.25.045 identifies the objectives for the site plan, The site plan provided in this application meets the objective of the code. The plan shows the location of the building, access to and from the site, parking lot layout, landscaping, snow storage and location for signage. The plan provides 34 s#andard parking spaces, 2 handicap spaces and a fuel truck parking area. The hangar-portion of the building is 6,129 square feet. The cede requires 08-12 {0748} Comment.doc Page 3 one space far every 1000 square feet of gross floor area for a required 7 spaces. The two-story office portion of the building is 9292 square feet. The code requires one space for every 400 square feet of gross floor area for a required 24 spaces. The cafe is shown as having 36 seats. The code requires 1 space for every 4 seats. Based on the information provided, .the development requires 40 parking spaces. Section 14.20.250(b}{2) of the Kenai Municipal Code provides an exception for buildings with multiple uses sharing one parking lot to provide seventy-five percent (75%) of the required spaces. The parking shown meets the code requirements. The parking lot will be paved. The plan shows a dumpster northwest side of the hangar portion of the building. The plan shawl the dumpster behind an 8-foot high chain link fence "with visual barrier." The building permit includes a plan for the dumpster screening as required by code. Sign permits are issued as part of the building permit. The Building Official will review proposed signage to insure signage meets both the building code and zoning code for size and location prior to issuing the permit. The site plan shows the hangar is placed approximately 49.8' feet from the lot line on the rear of the lot. The Airport Building Restriction Line (BRL) for this property is 50 feet. There is no variance process for this requirement and the hangar must be placed to meet the 50-foot BRL. The plan shows existing security fence that will be removed and new 8' high security fence that will be installed along Granite Point Street. This section of fence will be attached to an existing fence. The location on the site plan shows the fencing in the right-of-way. Mary Bondur~nt, Airport Manager, must be contacted prior to removing security fencing or adding additional fencing to insure the fence and location meets the airport security requirements. In addition, the City of Kenai Public Works Department must be contacted prior to placement of fencing in the right-of-way. An excavation permit may be required. Cit En ineer: Buildings must be placed outside the Airport ALP designated restricted areas. Drainage and snow storage appear adequate. Access issues have been addressed. Building Official: Aircraft hangars require a minimum 30-foot setback from property lines unless walls are constructed with a 2-hour rating. RECOMMENDATIONS The landscapelsite plan for the proposed Arctic Barnabas Ministries multiple-use {hangar/officelcafE) building appears to meet the objectives of KMC 14.28. This site plan is approved with the following requirements: 1. All landscaping as presented in the approved landscaping plan must be installed within one year after issuance of Certificate of Occupancy. 2. One hundred percent {100%) of ground cover of the landscaping beds must be planted and maintained so that there is na exposed soil within three years of the approved plan. 3. The plan shows landscaping into the edge of the City's right-of-ways along Granite Pant Street and Willow Street. Robert Frates, City of Kenai Parks 08-12 (0748) Comment.dac Page 4 and Recreation Director must approve this landscaping prior to construction. Mr. Frates noted a concern that an irrigation plan be developed to insure that the right-of-way landscaping will be watered and maintained. 4. .The building must be placed to meet the 50-foot Airport Building Restriction Line. 5. Prior to removing airport security fence or installing new fencing, Mary Bondurant, Airport Manager must be consulted to insure airport security requirements are met. 6. Prior to installing fencing shown in the right-of-way, or any digging in the City's rights-of-ways, the City of Kenai Public Works Department must be contacted to obtain an excavation permit. 7. Driveway permits must be obtained from the City of Kenai Public Works Department far the access onto Granite Point Street and North Willow Street. 8. The parking lot must be paved within two {2) years of the Certificate of Qccupancy. 9. Snow storage must be located on the lot and cannot be placed on required parking spaces or the snow must be removed from the site. No snow may be stored in such a manner that would block visibility far ingress and egress to the lot. 10. The structure for the dumpster must be constructed of wood or concrete. City administration may approve an alternative plan prior to construction. 19. If construction of the project has not started within one year of the approval of the landscapinglsite plan, the approval shall lapse unless extended for good cause. Report prepared by: Marilyn K. Freas, Kenai City DATE: February 21, 2008 RE: PREPARATION OF COMMISSION/COMMITTEE PACKETS During a recent commission meeting, a discussion took place about the meeting packets and a desire to have them provided as a PDF file. This discussion has come up previously and at that time, it was felt that packets should continue to be provided as a hard copy. Presently, packets are copied and mailed to all seven of the commissions/committees provided through this office as well as the Planning 8~ Zoning Commission. To maintain consistency and less confusion, this method will continue, However, on the same day the packets are prepared and copied (which is done a week prior to the meeting), the packets are also uploaded as a PDF file to .the city's webpage where it could be downloaded and saved to a hard disk if so desired. `1Ve have been uploading complete packets of all the commissions/committees since our new copier/ scanner was installed. The scanner only scans in black and white and that is why we try to provide valor copies of maps, etc, in packet envelopes along with the hard_copied packet. It is my understanding, a member indicated the City Council's packets are sent to them as a PDF file. This is incorrect. At their direction, the council members receive a hard copy of the meeting packet, In addition, a copy of the packet is placed on the city's webpage where it can be viewed or downloaded and saved if desired.
