PLANNING AND ZONING COMMISSION
RESOLUTION NO. PZ13 -40 APPROVING THE TRANSFER OF CONDITIONAL USE
PERMIT FROM KENAI LANDING INC., JON FAULKNER, PRESIDENT TO PRL
LOGISTICS, INC., C/O RON HYDE
WHEREAS, the Commission finds:
1. A Conditional Use Permit was granted to Jon Faulkner and Steve Aqni on October
22, 2003.
2. The original Conditional Use Permit is still in effect.
3. PRL Logistics, Inc. C/O Ron Hyde has purchased Units 5 and 6, a portion of the
interest in land from Tract A, Kenai Landing Cottages Subdivision.
4. The original Conditional Use holder(s) has consented to the transfer.
5. The transfer requires the new land owner to operate under the same conditions of
the original Conditional Use Permit and application:

NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI THAT THE CONDITIONAL USE PERMIT
GRANTED TO JON FAULKNER AND STEVE AGNI - KENAI LANDING INC. FOR
HOTELS, MOTELS, RESTAURANT, BAR, FOOD VENDORS BAKERY THEATRE/
COMMERCIAL RECREATION, AND RECREATIONAL VEHICLE PARK BE
TRANSFERRED TO PRL LOGISTICS, INC C/O RON HYDE FOR THE PROPERTY
DESCRIBED AS: TRACT A, KENAI LANDING COTTAGES SUBDIVISION — 2101
BOWPICKER LANE UNITS 5 & 6. ANY PROPERTY NOT INCLUDED IN THIS
TRANSFER, REMAINDER OF PARENT PARCEL, SHALL RETAIN THE ORIGINAL
CONDITIONAL USE PERMIT.
PASSED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI,
ALASKA, DECEMBER 11,2013.

The project appears to meet the requirements for a conditional use permit.
Recommend approval with the following requirements:
1. Comply with all state, local, and federal regulations.
2. Submit State of Alaska, Department of Environmental Conservation
documentation of approval for septic systems and water systems for the
conditional uses.
3. Provide landscape /site plans for review and approval when applications for
building permits are submitted.
4. Provide landscape /site plan for the recreational vehicle park for review and
approval.
5. If the recreational vehicle sites are increased in the future, submit landscape /site
plan for approval.
6. Provide verification of sales tax registration with the Kenai Peninsula Borough.
7. Mark all buildings with proper unit number not less than 4 ".
8. Review 2014 annual report to verify that all uses were operated otherwise the
Conditional Use Permit must be amended to remove the uses not operated.
