City Manager Koch reviewed the staff report included in the packet.

ANALYSIS
General Information:
The applicant is proposing to operate a funeral home, crematory, mortuary preparation
room, gathering and seating area for celebration of life functions and activities. There is
one structure located on Lot 1 and two structures on Lot 22A. The applicants currently
operate eight similar facilities within the State of Alaska: three in Anchorage, two in
Fairbanks, one in Palmer, one in Wasilla & one in Juneau. They also have a cemetery in
Fairbanks.
These properties have been used for both residential and commercial purposes
periodically for several years. The properties are located within the Limited Commercial
zone. The properties are accessed from Dogwood Road and Fireweed Lane paved City
maintained roadways. The properties meet the minimum lot size requirements for the
Limited Commercial zone and are served by city water and sewer utilities.
In 1995, the Planning & Zoning Commission approved PZ 95 -44 a preliminary
subdivision plat and utility easement vacation to eliminate an encroachment of a structure

built within an existing utility easement. In 2005, PZ05 -08 was approved rezoning this
area from General Commercial to Limited Commercial. At that time, properties located
within the General Commercial zone were not subject to zoning setbacks. When these
properties were rezoned to Limited Commercial they were required to meet the new
zoning requirements that included maximum building square footage and setbacks.
According to the Kenai Peninsula Borough Assessing reports no structure exceeds the
maximum 3,000 square foot building footprint. Applicant will register with the Kenai
Peninsula Borough to collect sales tax upon approval of the Conditional Use Permit.
KMC 14.20.150 details the intent and application process for conditional uses. The code
also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
• The use is consistent with the purpose of this chapter and the purposes and intent
of the zoning district.
o Staff f nds the proposed development meets this standard.
The properties are located within the Limited Commercial (LC) zone. The
intent of the LC Zone is established to provide transition areas between
commercial and residential districts by allowing low to medium volume
business, mixed residential and other compatible uses which complement and
do not materially detract from the uses allowed with adjacent districts.
The applicant proposes to operate a funeral home, crematory, mortuary
preparation room, gathering and seating area for celebration of life functions
and activities. Access to the properties will be directly off Dogwood Road and
Fireweed Lane. A comparable business is located within approximately 340
feet to the west, and the City has no complaints on file concerning traffic
problems, so there should be minimal traffic generated by the facility. The
properties will be landscaped to provide separation from adjoining properties
and will not violate the residential character of the area.
Adjacent developed properties are commercial businesses. The applicant
believes that business will enhance the appearance of the area and is centrally
located to Kenai and Soldotna, as well as the entire Kenai Peninsula.
• The value of the adjoining property and neighborhood will not be significantly
impaired.
o Staff finds the proposed development meets this standard.
The proposed development must meet commercial building and fire codes. A
landscaping /site plan must be submitted and approved. Site plans are
required to provide for orderly and safe development. Landscaping will
provide attractive and functional separation and screening between uses. The

proposed development site is large enough to provide sufficient separation
from adjoining developments, especially the residential subdivision.
This property is located off Dogwood Road and Fireweed Lane, which
provides access to multiple neighborhoods. A residential structure and
vacant lots are located to the south the property; property to the north is
undeveloped. Alicia's Eagle Rock Lodge is adjacent to the property on the
east boundary and the Fraternal Order of Eagles is adjacent to the property
on the west boundary.
The applicants intend to maintain the existing "lodge type" appearance and
will be making no modifications to the outside of the structure, other than
enhancing the landscaping.
The proposed development will not impair the value of the adjoining
neighborhood.
• The proposed use is in harmony with the Comprehensive Plan.
o Staff finds the proposed development meets this standard.
The 2003 Comprehensive Plan defines the Neighborhood Commercial district
as a district that applies to areas along the arterial road system that are
suitable for small -scale neighborhood- serving retail, service and office uses.
Applicant states the business is consistent with the current comprehensive
plan as outlined on Page 2 titled "Goals for the Plan ", item 1. The addition
of a funeral home in the Kenai will create healthy fair competition for the
residents of Kenai and the rest of the Kenai Peninsula, #3 "to meet the needs
of Kenai's growing senior population. "
• Public services and facilities are adequate to serve the proposed use.
o Staff finds the proposed development meets this standard.
The properties are served by City water and sewer. Dogwood Road and
Fireweed Lane are paved.
• The proposed use will not be harmful to the public safety, health or welfare.
o Stafffnds the proposed development meets this standard.
Brand new Crematory to be installed is new generation state of the art equipment
that is highly efficient, faster cycling, and cleaner emission. The Crematory will
meet all EPA requirements (less than 1, 000 lbs per hour solid emission).
Location of crematory will be located behind the main building with screening
from the public.

Any and all specific conditions deemed necessary by the commission to fulfill the
above - mentioned conditions should be met by the applicant. These may include,
but are not limited to measures relative to access, screening, site development,
building design, operation of the use and other similar aspects related to the
proposed use.
• Facility be licensed by the State of Alaska and managed in compliance with
State licensing requirements.
• Remove existing lot line to eliminate any possible zoning violations.
• Submit a landscape /site plan showing parking spaces. No building permits
can be issued without an approved landscape /site plan.
• A sight- obscuring fence is required for all outside storage.
• Register with the Kenai Peninsula Borough to collect sales tax.

RECOMMENDATIONS
Based on the application and a review of the criteria required to approve the permit, it
appears the application meets the intent of the zone and complies with the
Comprehensive Plan. Recommend approval with the following requirements:

State licensing requirements
• Remove existing lot line to eliminate any possible zoning violations
• Submit a landscape /site plan showing parking spaces. No building permits

PROCEDURES FOR PERMITS RECIURING PUBLIC HEARINGS AND NOTIFICATIONS
The permit you have applied for may require Public Hearing and Notification under KMC
14.20.280. The Planning and Zoning Commission meets the 2nd and 4'r, Wednesday of each
month. To meet notice requirements, the Planning Department must receive your completed
application 21 days prior to the meeting when the Public Hearing is scheduled.
• Applications requiring Public Hearings must be filed no later than noon on the date of the
deadline.
• Home Occupations and Landscape /Site Plans do not require a Public Hearing.
• Allow up to 4 weeks for the permitting process.
• If required:
• The Fire Inspection Report must be received prior to processing the application.
• The Affidavit of Posting must be received 2 weeks prior to the hearing date in
order to schedule a public hearing.
• Resolutions cannot be issued until expiration of the 15 -day appeal period.
• Resolutions cannot be issued until documentation is received that the certificate
of compliance is met.

II. Goals for the Plan
The goals for the Comprehensive Plan were developed at
two community workshops and several Planning and Zoning
Commission work sessions. These goals provide the
rationale for the proposed development policies and for
specific planning recommendations.
1. Create an attractive, vital, city center, with a mix of
private and public facilities and activities to benefit
residents and visitors.
Protect and rejuvenate the livability of residential
neighborhoods.
3. Meet the needs of Kenai's growing senior population.
4. Promote residential and commercial development.
5. Provide appropriate city facilities and levels of service.
6. Protect the city's natural areas and scenic views.
7. Develop a local system of trails and appropriate access
to public lands, and regional trails along arterials that
traverse the city.
8. Maintain public safety resources at a level commensurate
with growth.
9. Expand existing or provide new public facilities that
increase the quality of life for Kenai's citizens and
visitors.
Goals for the Plan
Previous Comprehensive Plans
Kenai has had four comprehensive plans. Each plan reflects the
circumstances and development priorities of its era.
1962 Comprehensive Plan. Kenai's first plan was prepared shortly
after the city incorporated in 1960 with 778 residents. At that time, most
development was clustered around Old Kenai. The oil and gas industry
was in its infancy. Optimism abounded. The city was growing rapidly,
with its population forecast to reach 13,350 persons by 1980. The plan
stressed land development and basic infrastructure, and proposed
Kenai's first planning ordinances.
1965 Comprehensive Development Plan. New opportunities opened
by transfer of the airport to city ownership in 1,963 prompted this update
of the 1962 plan. The plan proposed development of a major new public
office and commercial district on surplus airport property in central Kenai
and creation of an historic district for Old Kenai. The plan also proposed
a Kenai River bridge, a new regional jetport south of the river, and a
Northwest Coastal Highway to a Turnagain Arm Crossing. This plan
assumed a scaled -down forecast of 5,275 residents by 1980.
1980 Kenai Comprehensive Plan. Kenai saw several boom -bust
cycles during the 1960s and 1970s. This plan was prepared after the
TAPS construction boom and after several offshore oil and gas lease
sales in Cook Inlet. It forecast 6,140 residents by 1990, plus another
4,530 persons if there were significant new oil and gas discoveries. In
response to Kenai's sprawling growth, the plan emphasized central
business district development and the emergence of distinctive
residential neighborhoods. Reflecting the spirit of its time, this plan
presupposed an activist city government and stressed environmental
considerations.
1992 City of Kenai Comprehensive Plan (revised 1996). After the
mid -1980s recession, Kenai geared down its growth and development
expectations. This plan assumed a year 2000 population of 8,150
persons. Reviving the local economy was a major planning goal.
Ambitious development projects gave way to incremental improvements
to city infrastructure, better planning administration, and management of
the city's land base.

ANALYSIS
On October 22, 2003, the Planning and Zoning Commission approved Conditional Use
Permit PZ03 -43. The applicants Jon Faulkner and Steve Agni dba Kenai Landing Inc.,
included a detailed description of the proposed development plan for this property, "the
petitioner's plans to revitalize this community with a visitor - friendly mix of retail and
hotel -style uses, including overnight and weeklong lodging with a historic theme, small
scale value added fishing processing, and a vibrant arts and entertainment scene." The
applicants applied for a conditional use permit for the following uses:
• Hotels /Motels
• Restaurant
• Sales of Alcohol Beverages (bar)
• Food Vendors
• Bakery
• Theatre
• Commercial Recreation (commercial presentations)
• Recreational Vehicle Park
The property is surrounded by properties zoned heavy industrial and the redevelopment
has not adversely affected these properties. The City has received no complaints
during the operation of the permitted uses though many of the uses have not operated.
The parcel is approximately 57 acres, the size of the parcel allows for development with
minimal effect to the neighboring parcels.
In 2012, Kenai Landing, Inc. created Kenai Landing Commercial Condominiums a
common interest community within which residential and commercial buildings and
improvements may be constructed. it is the intent of the parties to transfer the rights
and interests in the Conditional Use Permit from the current permit holders (transferor)
to the new permit holder (transferee) only for the area /unit purchased by the transferee
while the transferor maintains the Conditional Use Permit for the remainder of the
Parcel.
Roger Stiles with Great Pacific Seafoods, Inc. purchased an interest in the property (a
unit or units of the common interest community) described above and has filed an
application requesting transfer of Conditional Use Permit PZ03 -43. The original
Conditional Use Permit holder(s) have consented to the transfer. The applicant has
agreed to be bound by the plan and statement(s) contained in the application of the
original permit. If at any time the applicant amends conditional use PZ14 -02, a public
hearing will be required. The State of Alaska Business License website does not show
a business license for Great Pacific Seafoods, and the Kenai Peninsula Borough Sales
Tax Department does not show them as being registered to collect sales tax.
Building Official: Existing uses on transferor units are unaffected. Any new uses or
changes of use must comply with all current codes, even if the new or changed use is in
existing buildings. For example, if the use in a building changes, the building must
meet current code standards for the new or changed use. All buildings must be marked
with its proper unit number not less than 4" as prescribed in KMC 14.15.060(b).
RECOMMENDATIONS
Kenai Municipal Code 14.20.150(i) outlines the process for Conditional Use Permits
that lapse, uses that cease for a period of time, and time extensions. Because the
applicant intends to use all of the individual uses outlined above, and separating the
uses would require a public hearing, staff is recommending the uses remain under one
Resolution number for now. However, if the 2014 annual report shows some uses were
not utilized, a public hearing will be scheduled to specifically modify the Resolution to
include only the uses that were operated.

2. Submit State of Alaska, Department of Environmental Conservation
documentation of approval for septic systems and water systems for the
conditional uses.
3. Provide landscape /site plans for review and approval when applications for
building permits are submitted.
4. Provide landscape /site plan for the recreational vehicle park for review and
approval.
5. If the recreational vehicle sites are increased in the future, submit landscape /site
plan for approval.
6. Mark all buildings with proper unit number not less than 4 ".
7. Provide copy of current State of Alaska business license.
8. Provide verification of sales tax registration with the Kenai Peninsula Borough.
9. Copy of recorded condominium declaration.
10. Review of 2014 annual report to verify that all uses were operated otherwise the
Conditional Use Permit must be amended to remove the uses not operated.

Planning & Zoning currently has five (5) active code cases:
• Two (2) Debris and Junk
• One (1) Building Violation
• One (1) Junk Vehicle
• One (1) case is in the Legal Department pending legal action. These property owners
are being sent monthly bills and assessed daily fines.
Administration is currently working with three (3) individual property owners to eliminate
violations without taking formal action.

A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION RECOMMENDING
THE KENAI CITY COUNCIL ENACT CHANGES TO KENAI MUNICIPAL CODE CHAPTER 14.05
PLANNING AND ZONING COMMISSION, TO PROVIDE FOR LIMITED TELEPHONIC
PARTICIPATION BY PLANNING AND ZONING COMMISSIONERS AT PLANNING AND
ZONING COMMISSION MEETINGS.
WHEREAS, City Council Members may participate telephonically at Council Meetings pursuant to KMC
1.15.130 Telephonic participation; and,
WHEREAS, the Planning and Zoning Commission is the only body of the City other than the City
Council that regularly meets twice a month; and,
WHEREAS, allowing Planning and Zoning Commissioners to participate telephonically at Planning and
Zoning Commission Meetings similar to what is allowed for Council Members may ease the burden of
service for Commissioners and encourage greater participation at meetings without detracting materially
from the process.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF
THE CITY OF KENAI, ALASKA:
That the City of Kenai Planning and Zoning Commission recommends Council enact amendments to
Kenai Municipal Code Chapter 14.05, Planning and Zoning Commission, as provided in Ordinance No.
2734 -2014, to provide for limited telephonic participation by Planning and Zoning Commissioners at
Planning and Zoning Commission Meetings.

Mr. Lierman reviewed the City's account summary advising the City's investment returns
have exceeded what was originally projected. Ms. Niclai provided a 2013 Market Recap,
reviewed the City's portfolio, and the 2014 economic and market outlook and long term
expected return.

Vice Mayor Marquis MOVED to enact Ordinance No. 2734 -2014, Enacting Kenai
Municipal Code 14.25.025 Telephonic Participation at Planning and Zoning Meetings, to
Allow for Limited Telephonic Participation at Planning and Zoning Commission Meetings
by Commissioners. Council Member Bookey SECONDED the motion.
Mayor Porter opened the public hearing, there being no one wishing to speak the public
hearing was closed.
Jeff Twait, Chair of the Planning and Zoning Commission, advised the resolution
failed by a 3/2 vote, him being on the prevailing side. Mr. Twait offered possible
amendments spoke in favor of the concept.
Council Member Molloy recommended all Commissioners be present in attendance for
any quasi- judicial proceedings.

At its meeting on January 15, 2014 City Council amended and referred to the Planning
& Zoning Commission Ordinance No. 2734 -2014, which would enact a section within
the Kenai Municipal Code to allow for a limited telephonic participation at P &Z
commission meetings by commissioners.
The Ordinance was referred to the Commission for review and a recommendation to

It was requested to have the recommendation to Council by its February 5th meeting;
however, after discussion with the Planning Department, it was determined this was not
a realistic time frame as the packet for the commissions last January meeting had
already been compiled /distributed. I recommended not placing this item as a lay down
without the proper notice /advertising since there was public input at the commission's
last meeting regarding this topic. This item should be placed on the commission's first
meeting in February.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ENACTING
KMC 14.25.025- TELEPHONIC PARTICIPATION AT PLANNING AND ZONING
MEETINGS, TO ALLOW FOR LIMITED TELEPHONIC PARTICIPATION AT PLANNING
AND ZONING COMMISSION MEETINGS BY COMMISSIONERS.
WHEREAS, City Council Members may participate telephonically at Council Meetings
pursuant to KMC 1.15.130- Telephonic participation; and,
WHEREAS, the Planning and Zoning Commission is the only body of the City other
than the City Council that regularly meets twice a month; and,
WHEREAS, allowing Planning and Zoning Commissioners to participate telephonically
at Planning and Zoning Commission Meetings similar to what is allowed for Council
Members may ease the burden of service for Commissioners and encourage greater
participation at meetings without detracting materially from the process; and,
WHEREAS, at the regular Planning and Zoning Commission meeting of January 8,
2014, the Planning and Zoning Commission recommended the City Council
Ordinance 2734 -2014.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA
Section 1. Form: That this is a Code ordinance.
Section 2. Enactment of Section 14.05.025 of the Kenai Municipal Code: That Kenai
Municipal Code, Section 14.05.025 - Telephonic Participation at Planning and Zoning
Commission Meetings, is hereby enacted as follows:
14.05.025 Telephonic Participation at Planning and Zoning Commission
Meetings.
(a) A commissioner may participate via telephone in a Commission meeting if the
commissioner declares that circumstances Prevent physical attendance at the
meeting. If the chair chooses to Participate via tele hone the vice -chair shall Preside.

(c) The commissioner shall notify the Clerk's office in writing as soon as reasonably

that the member proposes to attend by telephone Such notification shall state
whether such telephonic participation is Pursuant to subsection (n) or (o) and shall
provide the Physical address of the location the telephone number, and any available
facsimile email or other document transmission service. Failure to Provide the
notification within the Period of time Provided herein shall result in the member's
exclusion from attendance of a Commission meeting through telephonic participation
The Clerk or designee shall notify all Commission members of the request
(d) At the meeting, the Clerk or designee shall establish the telephone connection
when the call to order is imminent.
(e) A commissioner Participating by telephone shall be counted as present for
purposes of discussion and voting
(f) The commissioner participating by telephone shall make every effort to
participate in the entire meeting. From time to time during the meeting the presiding
officer shall confirm the connection.
(g) The commissioner participating by telephone may ask to be recognized by the
Presiding officer to the same extent as any other member.
(h) To the extent reasonably practicable the Clerk or designee shall provide backup
materials to commissioners Participating by telephone at the commissioner's expense
(i) If the telephone connection cannot be made or is made and then lost the
meeting shall commence or continue as scheduled and the Clerk or designee shall
attempt to establish or restore the connection
(i) Meeting times shall be expressed in Alaska time regardless of the time at the
location of any commissioner participating by telephone
(k) Participation by telephone shall be allowed for regular, special and work session
meetings of the Commission.
(1) Remarks by commissioners participating by telephone shall be transmitted so
as to be audible by all members and the Public in attendance at the meeting Provided
that in executive session the remarks shall be audible only to those included in the
executive session.
(m) As used in these rules "telephone" means any system for synchronous two (2)
way voice communication. "Chair" includes the Vice -Chair or any other commissioner
serving as chair Pro tempore.
(n) Each commissioner may attend a maximum of four (4) meetings by
teleconference during the twelve (12) month Period starting November 1st of each year.
(o) A commissioner may attend an additional two (2) meetings by teleconference
during a twelve (12) month Period starting November 1st of each year if the member
declares that he or she is Physically unable to attend the meeting due to the need for
extended medical care and treatment of the member or member's immediate family.

(y) In this section "immediate family" means the spouse of the person another
Person cohabitatmg with the person in a conjugal relationship that is not a legal
marriage, a child (including a stepchild or foster child) of the person a parent sibling
grandparent, aunt or uncle of the person or a parent or sibling of the persons spouse
Section 3. Severabilitv: That if any part or provision of this ordinance or application
thereof to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, such judgment shall be confined in its operation to the part, provision, or
application directly involved in all controversy in which this judgment shall have been
rendered, and shall not affect or impair the validity of the remainder of this title or
application thereof to other persons or circumstances. The City Council hereby
declares that it would have enacted the remainder of this ordinance even without such
part, provision, or application.
Section 4. Effective Date: That pursuant to KMC 1.15.070(1), this ordinance shall
take effect 30 days after adoption.
