HomeMy WebLinkAboutResolution No. 2014-20CITY OF KENAI RESOLUTION NO. 2014 -20 Suggested by: Mayor Porter Council Member Navarre A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, RECOMMENDING THAT THE ALASKA DEPARTMENT OF NATURAL RESOURCES SEASONALLY CLOSE VEHICULAR ACCESS ON A PORTION OF THE SECTION LINE EASEMENT ACCESSING THE CITY'S SOUTH BEACH TO THE NORTH OF DUNES ROAD. WHEREAS, a portion of "Old Cannery Road" 1 (more particularly described as that portion of the section line easement common to sections 7 and 18, Township 5 North, Range 11 West, Seward Meridian, Alaska, lying West of the intersection of Old Cannery Road and Royal Street to Mean High Water of Cook Inlet) lies on a section line providing access to the City's South Beach; and, WHEREAS, the heaviest traffic accessing the South Beach occurs during the seasonal dip net fishery; and, WHEREAS, Dunes Road, approximately 1,600 feet to the south provides equal or better access to the South Beach; and, WHEREAS, vehicular traffic accessing the South Beach via "Old Cannery Road" creates an unsafe situation on the beach as vehicles attempt to merge with vehicles already traveling along the beach; and, WHEREAS, vehicle traffic accessing the South Beach via "Old Cannery Road" has caused private property damage according to the adjacent private property owners; and, WHEREAS, in the past the City has seasonally maintained a fee station on both "Old Cannery Road" and Dunes Road for the dip net season; and, WHEREAS, closing beach access to non - emergency vehicles via "Old Cannery Road" during the dip net fishery will likely improve beach safety, protect private property interests, and allow the City to more efficiently regulate beach activities during the period of heaviest use; and, WHEREAS, the Alaska Department of Natural Resources has in the past locally asserted authority over closures of section line easements. New Text Underlined; [DELETED TEXT BRACKETED] Resolution 2014 -20 Page 2 of 2 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: Section 1. That the City of Kenai requests the Alaska Department of Natural Resources to close or otherwise allow the City to close, during the Kenai personal use dip net fishery, a portion of "Old Cannery Road" 1 (more particularly described as that portion of the section line easement common to sections 7 and 18, Township 5 North, Range 11 West, Seward Meridian, Alaska, lying West of the intersection of Old Cannery Road and Royal Street to Mean High Water of Cook Inlet) to all motorized vehicles accessing the City's South Beach, except emergency response vehicles. Section 2. That the City Manager is authorized to negotiate with the Alaska Department of Natural Resources and after review from the City Attorney, execute any agreement(s) reasonably necessary to accomplish such closure. The purpose of this correspondence is to recommend Council adoption of Resolution 2014 -20. This resolution requests the Alaska Department of Natural Resources (ADNR) allow the City of Kenai to seasonally close access on the section line easement accessing the City's south beach, on what is commonly described as a portion of "Old Cannery Road." The portion of the section line easement for which the City is requesting permission for a seasonal closure, is more particularly described as, "that portion of the section line easement common to Sections 7 and 18, Township 5 North, Range 11 West, Seward Meridian, Alaska, lying west of the intersection of Old Cannery Road and Royal Street to Mean High Water of Cook Inlet." Dunes Road, approximately 1,600' to the south, provides equal or better access to the south beach. The significant volumes of traffic utilizing the section line easement at Old Cannery Road has caused damage to the unimproved roadway, creates an unsafe condition on the beach when vehicles are attempting to merge with vehicles which have gained access at Dunes Road, and causes significant disruption to the residence and residential properties located along the section line easement. Please find attached aerial photography identifying that portion of the section line which the City is requesting this action from ADNR.
