ORDINANCE NO. 2746 -2014
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA,
APPROPRIATING FUNDS FOR THE PURCHASE OF A 2014 FORD INTERCEPTOR
SEDAN TO REPLACE THE SEDAN TOTALED DURING A TRAFFIC STOP ON MARCH 8,
2014 AND AUTHORIZING THE PURCHASE THROUGH THE STATE OF ALASKA
EQUIPMENT FLEET CONTRACT.
WHEREAS, on March 8, a Kenai Police Department cruiser suffered extensive damage
when it was rear -ended on Bridge Access Road; and,
WHEREAS, a damage estimate indicates the 2013 Ford Interceptor sedan is totaled;
and,
WHEREAS, insurance proceeds from the driver at fault are expected to be sufficient for
the replacement of the vehicle; and,
WHEREAS, the Police Department needs to replace the sedan as soon as possible with
a 2014 Ford Interceptor sedan; and,
WHEREAS, Kendall Ford in Wasilla is awarded the State of Alaska equipment fleet
contract for the purchase of Ford Police Interceptors; and,
WHEREAS, KMC 7.15.050(f) allows the City of Kenai to purchase equipment without
giving an opportunity for competitive bidding if the equipment is purchasable under
the contract of another governmental agency in which contract the City is authorized
to participate; and,
WHEREAS, in past years, the City of Kenai has purchased police vehicles through the
State of Alaska equipment fleet contract.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA:
Section 1. Form. That this is a non -code ordinance.
Section 2. That estimated revenues and appropriations be increased as follows:
General Fund
Increase Estimated Revenues:
Restitution $27,770
Increase Appropriations:

Section 3. The purchase is authorized from Kendall Ford of Wasilla utilizing the State
of Alaska equipment fleet contract.

SUBJECT: Purchase of Police Vehicle
On March 8, 2014, a Kenai Police Department 2013 Ford Interceptor sedan was totaled in
a rear -end crash on Bridge Access Rd. The Police Department will replace the cruiser
with a 2014 Ford Interceptor sedan, which is available through State of Alaska fleet
pricing at Kendall Ford.
In past years, the City of Kenai has purchased police vehicles through State of Alaska
fleet pricing, to help ensure the City pays the lowest available cost for this equipment.
The State of Alaska Contract Fleet Award is an inherently competitive process, allowing
for Ford dealerships across the State to bid on Police Interceptors.
Per KMC 7.15.050(f) equipment may be purchased without giving an opportunity for
competitive bidding if the equipment is purchasable under the contract of another
governmental agency in which contract the City is authorized to participate.
I am requesting that the City of Kenai purchase one 2014 Ford Police Interceptor sedan
under the State of Alaska equipment fleet contract. The Kendall Ford price for the Police
Interceptor sedan, per State of Alaska fleet contract award, is 27,770. This price includes
the road ready package and reverse sensing.

SUBJECT: Ordinance No. 2749 -2014
Harbor Commission's Recommendation for Council
At the Harbor Commission meeting on Monday 04- 07 -14, the Commission considered
Ordinance No. 2749 -2014 Enacting KMC 11 105.100 — No Wake Zones, which would codify
the authority of the City Manager to establish no wake zones within the Kenai Harbor outside of
the Kenai River Special Management Area, subject to change by the Council. Co- sponsor
Council Member Gabriel was present at the meeting to make comments, answer Commissioner's
questions, and participate in discussion.
The Commission's discussions, including discussions with Council Member Gabriel, covered the
public safety issues, the five (5) mph limit in subparagraph (c) as may be affected by very high
ebbing tides, the property erosion issues, the need for appropriate signage as provided in
subparagraph (d) of the ordinance, jurisdictional issues, and enforcement, among other topics.
Individual Commissioners expressed support for the City taking its own steps to address
dangerous conditions in the Kenai Harbor and erosion caused by the great number of vessels
operating at various speeds in close proximity to each other during the concurrent seasons of the
dip net, commercial, and sport fisheries each July.
The Harbor Commission voted unanimously to approve a motion to support enactment of
Ordinance No. 2749 -2014.
Therefore, the Last WHEREAS clause could be amended to state:
WHEREAS, at its regularly scheduled meeting of April 7, 2014, the Harbor
Commission recommended enactment of this ordinance.
