CALL TO ORDER & ROLL CALL Chair Morin called the meeting to order at 7:02 p.m. Roll was confirmed as follows: Commissioners present: Chair P Morin, B. Peters, T. Thompson, V. Askin Commissioners absent: Staff /Council Liaison present: A quorum was present. 2. AGENDA APPROVAL MOTION: G. Greenberg, W. Nelson, Public Works Director S. Wedemeyer, Council Member R. Molloy Commissioner Peters MOVED to approve the agenda and Commissioner Askin SECONDED the motion. There were no objections. SO ORDERED. 3. APPROVAL OF MEETING SUMMARY — April 7, 2014 MOTION: Commissioner Thompson MOVED to approve the meeting summary of April 7, 2014 and Commissioner Askin SECONDED the motion. There were no objections. SO ORDERED. 4. PERSONS NOT SCHEDULED TO BE HEARD Ken Tarbox spoke in support of Ordinance No. 2756 -2014. 5. UNFINISHED BUSINESS — None. 6. NEW BUSINESS a. Ordinance No. 2755 -2014 — Amending Kenai Municipal Code 13.20.035 - Camping, Fires, and other Activities on City Beaches, to Authorize the City Manager to Temporarily Regulate Beach Activities to Protect Public Safety, Health or Welfare, and for City Maintenance of Property. MOTION: Commissioner Thompson MOVED to support enacting the Ordinance and Commissioner Peters SECONDED the motion. There were no objections. SO ORDERED. b. Ordinance No. 2756 -2014 — Repealing Kenai Municipal Code 13.20.030 - Protection of North and South Shore, and Re- Enacting it as Kenai Municipal Code 13.20.030 - Protection of Environmentally Sensitive Areas, to Expand its Application and to Authorize the City Manager to Implement Restrictions on Public Entry, Access and Use for the Protection of Environmentally Sensitive Areas Owned or Managed by the City, Subject to Change by the Council. MOTION: Commissioner Askin MOVED to support enacting the Ordinance and Commissioner Peters SECONDED the motion. There were no objections. SO ORDERED. 7. REPORTS a. Public Works Director— Wedemeyer reported a possible grant to fund 50% of Dredging Project. b. Commission Chair— Morin thanked Molloy for the ordinances and Nelson for bringing forward the list of outstanding issues. C. City Council Liaison — Molloy on the reported on the May 7`" Council meeting noting the no -wake zone ordinance passed, discussed the closure of section line, the dipnet budget, feasibility study for the Bluff Erosion Project, and new committee members were confirmed. 8. NEXT MEETING ATTENDANCE NOTIFICATION — June 9, 2014 Commissioner Thompson noted he may be absent. 9. COMMISSIONER COMMENTS /QUESTIONS Commissioner Thompson inquired how May & June expenditures are funded and Wedemeyer advised they are funded out of FY14 funds. 10. This ordinance amends KMC 13.20.035 — Camping, Fires, and Other Activities on City Beaches to provide that, with reasonable public notice in advance, the City Manager may temporarily close City beaches, or portions of the beaches, to camping, stalling or maintaining open fires, parking, vehicular access and other similar activities in order to protect public safety, health or welfare, and for city maintenance of property. After discussion, the Harbor Commission voted unanimously to approve a motion to recommend passage of Ordinance No. 2755 -2014. Therefore, the Last WHEREAS clause could be amended to state: WHEREAS, at its regularly scheduled meeting of May 12, 2014, the Harbor Commission recommended, by unanimous vote, that Council pass this ordinance. Ken Tarbox, a member of the public, spoke in support of this ordinance. After discussion, the Harbor Commission voted unanimously to approve a motion to support Ordinance No. 2756- 2014. Continue to Pursue a Drift Boat Pull -Out Somewhere in the Lower River, Somewhere in the Vicinity of Cunningham Park. The City of Kenai Council included a Drift Boat Pullout on the Lower Kenai River in the FY2015 Capital Improvements Requests to the State of Alaska. The project was not included in the City's eight priority request that were submitted to the State through the CAPSIS System. The project, estimated to cost in excess of $2 million, was not funded by the State in the FY2015 budget. Administration will continue to keep this project on the capital improvement projects list for consideration of Council for submission as a request for State capital funding in FY2016. b. Seasonal or Permanent Potable Water Line to the Boat Launch Area. The water service to the Boat Launch from the transmission main located in the Bridge Access ROW has been completed. c. Address Riverbank Degradation Due to Dip Netting and Hunters in the Area of Warren Ames Bridge. The City Manager has raised this issue with the property owner, the Alaska Department of Natural Resources, Division of Parks & Outdoor Recreation, both directly and through the Kenai River Special Management Area Advisory Board. The City Manager has scheduled a meeting with the Area Parks Superintendent to further discuss this matter. Administration will provide a memorandum briefing the Harbor Commission following the meeting. The Alaska Department of Transportation & Public Facilities is planning to install "No Parking" signs along Bridge Access Road in the area of Warren Ames Bridge to increase roadway safety and discourage dip netting in this area. Administration is unaware of any habitat damage in this area being caused by hunters. d. An additional Day of Drift Boat Only Fishing on the Kenai River The City of Kenai submitted a proposal to the Alaska Board of Fish at the past Upper Cook Inlet Finfish Cycle in January /February 2014. There were a number of similar proposals submitted by other groups /individuals. The Alaska Board of Fish did not adopt any proposals to add an additional day of drift only fishing on the Kenai River. In early 2016, the Administration will suggest a Council work- session to discuss proposals for the Alaska Board of Fish Upper Cook Inlet Finfish Meeting to be held in early 2017. e. Dredging of the Boat Launch Area and City Dock The final design and construction phases for this proposed project are not funded at this time. The City Manager has directed the Director of Public Works to submit a grant request to the State of Alaska during the next grant funding cycle for Harbor Improvements. f. Various Other Projects Dealing With Paving, Parking and Other Improvements at the City Dock /Harbor. There are no Administration proposed projects for paving, parking or other improvements at the City Dock /Harbor. g. Restoration Project at the Bird Viewing Platform (Kenai Watershed Forum was /is Overseeing this Project). The Kenai Watershed Forum (KWF) is sponsoring and administering this proposed /potential project. Since discussions were held with the City Council this past winter the KWF has been working with consultants to determine the type of, and methods of planting, various vegetation to maximize success. Administration has not received a status report from the KWF since last winter for this proposed project.
